Sole proprietors, partners or a non-working director are not considered employees in terms of the Act. The Public Employee Association (PEA), once a respected union that fought for the rights and welfare of public servants, has unfortunately lost much of its effectiveness over the years. In its prime, it was a powerful advocate that employers feared, as it worked diligently to ensure fair treatment for its members. However, today it seems more focused on persuading public servants to join in order to boost its membership and pay bill, rather than actively fighting for individual employees' rights and justice in personal grievance cases. Many public servants have become financial members since the union’s inception, but far too many have found that their grievances remain unresolved, with some members passing away while still waiting for justice. If you're a new public employee considering joining PEA, ask critical questions before doing so. For example, what guarantees does PEA offer if you are mistreated by your employer? What legal options are available if you do not receive the support you need from them? What is their process for addressing grievances when union representatives do not respond to members’ needs? Before committing to membership, be cautious and ensure that PEA can offer the support and services that are promised. Staff representation matters! Whether internationally mobile or stationed in one place for their careers, UN staff share many of the same needs as domestic civil servants - a living wage, healthcare, pension, etc. However, many standard government benefits don't apply to international civil servants. This is why staff representation and associations like FICSA are so vital. We advocate for the rights and working conditions of international civil servants across the UN system. Budget 2025 is due to be delivered on Tuesday, October 1st. The INOU calls on the government to address the need for Supportive Employment Services through the following budget measures: Ensure that employment services are person centred and work with people in a supportive and pro-active manner, working with people so that they can avail of the most appropriate option for themselves. Pro-actively provide individuals and communities most disadvantaged in the labour market with tailor made supports to address their issues, including high support wrap around services. Resource the provision of good career and employment guidance to support unemployed people, regardless of whether or not they are on a payment, to make in-formed choices. It is seen before on multiple occasions, but this issue still persists - #crossborder #workers treated differently to residents resulting in unjustified reduction/indexation/denial of #socialsecurity benefits. In a recent case (see 👇) #European court confirmed (again) that cross-border workers (#frontierworker) may not be treated differently and disadvantageously to local residents in their claim for #familybenefits (#family #allownaces) on the basis of their residence in another #EU member state. It can be difficult for individual cross-border workers to identify when their benefits are unjustly reduced/denied. An indication of something not being exactly right can sometimes be found in reasoning for reduction/indexation/denial of benefits. If residence in another EU country, status of cross-border worker etc. is used to explain why benefit is cut or reduced, this could indicate that something might be off.
