A clear argument by Eric Crampton in support of compensation for “regulatory takings”. Imposing heritage listing on a property reduces its value, creating a private loss for public gain. This is unfair and encourages Councils to offload costs via heritage listing, even where other policies might achieve the same goals more cost-efficiently. All well and good. But totally one-sided. Eric is very clever and therefore well aware that just as new regulation imposes regulatory takings, deregulation provides “regulatory givings” – windfall asset value gains when land is upzoned or when restrictions are lifted. The economic impacts go both ways. So the moral case does too. Eric ignores those windfalls when calling for easier heritage delisting. This is fine; he’s lobbying for his members’ interests in lighter-touch regulation and untaxed windfall gains. NZ is a rent-seeker’s paradise and our rent seekers can afford quality frontmen. He’s still performing a social service by presenting one-sided arguments so clearly (thanks Eric). But you’d be a dupe to fall for it. The situation is symmetric. There are givings and takings, windfalls and wipeouts. If we compensate one, we should capture the other. Eric also appeals to the idea of “natural” property rights. Totally wrong. Land-use rights are always and everywhere circumscribed by the state – not just through zoning, design guides, and airspace rights, but through subsoil mineral ownership, the Crimes Act, employment law, environmental law, and so on. Everything done is done on land. Every law is, in effect, land-use law. There is no baseline or natural property right bestowed by title ownership. There is no pure and principled state of law to return to. It’s all socially determined; always has been. There isn’t even a coherent concept of “land” apart from a bundle of rights created by law. Land isn’t dirt, or sky, or 3D space. If you believe in natural property rights, try enforcing exclusive title in a libertarian state. Without publicly funded police to enforce the invisible lines on a publicly maintained map, how natural does ownership feel? Property rights in land are positive rights delivered by an active, interventionist state. They are not natural. They override nature. Built form rules are just the latest incarnation of social limits on private behaviour for the public good. They reflect social progress. Employment law was an earlier incarnation. Abolition of slavery another. As we progress, we regulate. Debate the state, sure. Fund heritage, obviously. But don’t harken back to a “natural” state of power red in tooth and claw unless you’re okay with the Mob camping on your lawn. Remember why we made laws in the first place. And remember Chesterton’s fence. My day job is to talk about land tax and resource rents in Australia, not local laws in NZ. You won’t find this commentary on Newsroom. 𝟮𝟬𝟮𝟱 𝗕𝗛𝗜𝗦 𝗴𝗿𝗮𝗻𝘁𝘀 𝗻𝗼𝘄 𝗼𝗽𝗲𝗻𝗲𝗱 - 𝘁𝗵𝗶𝘀 𝘆𝗲𝗮𝗿 𝗴𝗿𝗮𝗻𝘁𝘀 𝗼𝗳 𝘂𝗽 𝘁𝗼 €𝟱𝟬,𝟬𝟬𝟬 𝗮𝗿𝗲 𝗻𝗼𝘄 𝗮𝘃𝗮𝗶𝗹𝗮𝗯𝗹𝗲 Minister Noonan has announced changes to the Built Heritage Investment Scheme (BHIS) to allow for additional time to complete works and higher maximum grants. Grants of up to €50,000 are now available to cover the cost of maintaining and conserving Ireland’s architectural heritage. A significant increase on the previous maximum award of €15,000, the grants will provide a boost for owners seeking help to protect their building’s historic character. In addition, the timeframe of the scheme is changing with applications open from now until Friday 27 September. Successful projects will be announced in early January, giving owners and craftspeople additional time to schedule and complete their projects during 2025. Previously, application opened in November with awards announced in March of the following year.
