In August 2021, California signed its Extended Producer Responsibility law. This legislation targets various materials, such as packaging (package-like products and reusable packaging) and food serviceware. The legislation mandates compliance starting July 2025 and designates Circular Action Alliance as the registered Producer Responsibility Organization (PRO). Under this law, a “producer” is defined as the manufacturer and owner of a brand or trademark; in their absence, the licensee assumes responsibility. If the product is not manufactured within the state, the importer or distributor bears responsibility. The registration deadlines have now passed for Oregon and Colorado, but it is important to note that California registration will also be required. The growing trend in on-pack claims regarding use of “ocean plastics” or “ocean bound plastics” in product packaging has caught the attention of the ACCC, with the regulator indicating that misleading representations in relation to such claims is an enforcement priority. 🇪🇸 Extended Producer Responsibility (EPR) Starting January 1, 2025, labeling of household packaging will be mandatory in Spain. Here are the key requirements according to Real Decreto 1055/2022: 1. Waste Sorting: Clear indication of which bin the packaging belongs in (e.g., Yellow bin for plastic). 2. Reusable Packaging: Packaging that can be reused must carry the symbol of the deposit-return system (SDDR), informing consumers how and where to return the packaging. 3. Compostable Packaging: Compostable packaging must include certification details according to UNE EN 13432:2001. Additionally, the packaging must display the warning “do not litter” to ensure proper disposal. 4. Labeling: The labeling must be directly on the packaging or the label, clearly visible, legible, and durable. QR codes are not explicitly permitted, and terms like “environmentally friendly” are prohibited. Starting January 2025, compliance with these labeling requirements will be mandatory. #EPR #SpainPackaging
