Intestacy refers to the situation where an individual dies without a valid will. When this happens, state laws determine how the deceased's assets are distributed, which can lead to outcomes that may not reflect their wishes. Proper estate planning, including the creation of a will, ensures that your assets are distributed according to your intentions and provides peace of mind for you and your loved ones. #RothkoffLawGroup #RothkoffLaw #ElderLaw #ElderCareLaw #ElderCare

If the court determines that a will is invalid, the estate won’t be distributed as the deceased intended. Here’s what could happen: 1️⃣ Earlier Valid Will: The estate might be divided according to a previous valid will, if one exists. 2️⃣ Intestacy Rules: If no earlier will is valid, the estate will be distributed according to the rules of intestacy—these laws dictate how assets are divided when someone dies without a valid will. Understanding the consequences of an invalid will is crucial for ensuring your wishes are honored. Make sure your will is solid and legally sound! #WillDispute #EstatePlanning #Intestacy #LegalAdvice

Nuptial Agreements can reflect the financial discussions that you have had with your partner when seeking to protect assets, business interests, and future inheritance. They are not binding on the Family Court, but the Court must uphold the terms of a Nuptial Agreement if it was properly prepared, freely entered into and is fair to both parties. We want to ensure that you have an agreement that works for you both and helps protect both of you, now and in the future. If you've been online at all this week, you probably heard about the NAR Lawsuit. It's been comical to see some of the articles come out from 'reputable' news companies... I'm going to spend our time today going over these three questions: - Why was there a lawsuit in the first place? - What were they trying to change? - What was the real outcome of the settlement? ... and as always, from me, you're going to get this straight to the point and explain in a way we can all understand. (as I jokingly say, "Explain it to me like I'm a 3rd grader”) Watch the video here: https://lnkd.in/gK7ijEQ4 Read the blog here: https://lnkd.in/gDFBaN9B Christian Stubbs DRE# 02082942 Onyx Homes First Team Real Estate #narlawsuit #narsettlement #nar #realestate

The typical situation in which a defendant is liable for tortious interference with contract is when a defendant prevents a third party from performing its contract with the plaintiff. But a defendant may also be liable for tortious interference when it prevents the plaintiff from performing its contractual obligations with a third party.
On October 7, 2024, Justice Melissa A. Crane of the New York County Commercial Division issued a decision in EXRP 14 Holdings LLC v. LS-14 Ave LLC, Index No. 652698/2022, holding that a defendant may be liable for tortious interference with contract when the defendant causes the plaintiff to breach its own contract with a nonparty, explaining: See the full link: https://lnkd.in/e27bXqDE

The recent case of Cleave v Cleave tackles a significant question in proprietary estoppel claims: how to balance compensating someone for their losses against delivering on assurances made to them, especially when considering the financial circumstances of the person who made those promises. The case centred on a family dispute over the inheritance of a farm on the Devon and Cornwall border, where long-standing assurances and significant personal sacrifices led to a legal battle. In our latest article, Barny Croft and Hayley Andrew break down the case’s complex facts and the court’s decision, as well exploring two possible outcomes.
