I’m amazed. Amazed…that it took this long to act ! What is the value of these types of Apps ? At best they are an amusement. At worst they can be a powerful grey zone weapon manipulated by the CCP. https://lnkd.in/gZU8tQMf Even if the Australian government is too ideologically bound up to actually make preparations for the Defence of the nation, surely they have the garden variety, common sence to recognise a foreign interference tool when they see one ? https://lnkd.in/gPT9eWtT The government is sufficiently convinced of the covert potential of this App that it is already banned on government devices. https://lnkd.in/g6zqBC-D Australia needs to quickly follow the US lead.

I wish the US Congress would focus more on protecting the data of private citizens in general, both from rival countries AND from social media companies, rather than just looking at a single app. Why is this law directed at just a single platform? Data brokers gain access to vast troves of Americans’ personal data via scores of apps, websites, credit card companies and other businesses. Currently, there are few restrictions on what data can be collected or who can buy it. Biden admin officials have warned that China is already buying up this data, much of it more revealing than anything TikTok collects. https://lnkd.in/gT7mgF5H The House recently passed a bill that would bar data brokers from selling Americans’ personal information to “adversary” countries like China. But, if passed, the law wouldn’t address the sale of that data to other entities or the wholesale collection of it to begin with. Digital rights and free speech advocates like the Electronic Frontier Foundation (EFF) have also raised the possibility that the US forcing a ban or sale of TikTok could give other countries cover to enact similar bans or restrictions on US-based social media platforms. In a letter to lawmakers opposing the measure, the EFF, ACLU and other groups argued that it would “set an alarming global precedent for excessive government control over social media platforms.” “Shutting down a whole service is essentially an anti-democratic thing.”

On the 17th of February, the Digital Service Act (DSA) becomes officially effective for covered online enterprises. While big names such as Amazon, X(Twitter) and Meta have felt the effects of this regulation since August of last year, soon all digital platforms and intermediary services that fall under the act's definitions are going to be affected. It's all #PayOrOk at the moment and here's a date for your diary to expect some guidance from the #EDPB - March 2024. With very helpful insight from the #Norwegian #DPA on this issue, I just listened to an excellent discussion led by Joe Jones at IAPP - International Association of Privacy Professionals with fantastic and varied insights from Tobias Judin of the Norwegian DPA and Nathalie Laneret and Mikołaj Barczentewicz on #PayOrOK. We've had discussions that show we are just reaching the precipice of the impact of #advertising #behavioural advertising and other online activities in connection with personal data processing and in terms of the fight to preserve 'rights' but it's also something greater than advertising. What those rights are that we are protecting and what it means to have a 'right' was hotly debated as was the narrower scope of recent #CJEU judgements and the issue of legislative intervention, perhaps in the form of a reformed #GDPR or even regulatory laws. The key issues still remain: Can you consent if the entity offering you the option to consent is dominant and/or in a position of market power? If market power is not that which is measured in #antitrust/competition terms, what is it? What is the data protection answer to the data protection problem that we are trying to resolve? As a competition and data protection lawyer who also advised a universal and public service provider, much of the content discussed references many areas potentially new to #privacypros but are familiar to those from #competition and #regulated sectors. Now as we look at matters in a digital words, measures, approaches and meanings need to be reconsidered. I'll be taking a close look at the #European Commission's Revised Market Definition Notice that issued start of February. It's going to be a very busy spring! Great panel and great discussion. In February, India’s Committee on Digital Competition Law released a report that recommended identifying major digital enterprises and setting rules for their operations to prevent anti-competitive practices. As a result, the Digital Competition Bill (mirroring the EU’s Digital Markets Act) came into being. Digital services with 10M+ local users will be prohibited from exploiting non-public data of its users and promoting their own services over rivals. It also abolishes restrictions on downloading of third-party apps. Definitely a step in the right direction: more competition = more innovation 🚀
