The killing of Afghan migrants by Iran’s border police can be analyzed through several international legal frameworks, highlighting the violation of international law and norms by Iran. 1. International Covenant on Civil and Political Rights (ICCPR 1966): Article 6 prohibits arbitrary deprivation of life, which directly applies to the reported border killings. Iran, as a state party since 1975, is obligated to protect the right to life. The use of lethal force against unarmed migrants could constitute a clear violation of this article. 2. Convention Against Torture (CAT 1984): This convention obliges state parties to prevent acts of cruelty, inhuman, or degrading treatment. The use of excessive force and gunfire against migrants attempting to cross the border breaches Iran's obligations under Article 2 of the convention, which requires the prevention of torture and cruel treatment. 3. 1951 Refugee Convention and its 1967 Protocol: Even if these migrants were not formally recognized as refugees, Article 33 prohibits refoulement or returning individuals to territories where their lives or freedom would be at risk. The lethal actions by Iranian forces contradict the principle of protection for those fleeing conflict or persecution. 4. Customary International Law and UN Basic Principles on the Use of Force: Lethal force should only be used in exceptional circumstances, such as imminent threats to life. The use of direct gunfire and RPGs against migrants is disproportionate and unnecessary, violating these principles. #HumanRights #MigrationCrisis #InternationalLaw

Syria - Returns must be voluntary I. For now, returns can only be voluntary. Under European legislation, "Member States shall examine whether the change of circumstances is sufficiently profound and durable for the refugee’s fear of being persecuted to no longer be regarded as well-founded." (Articles 11 and 16 of Directive 2011/95/EU). II. Once peace proves durable, international protection may ceases. However, refugees may continue to reside in Portugal under the general regime for foreign nationals, rather than the special asylum protection regime. In 2023, Europe witnessed the highest number of people who lost their lives in the Mediterranean in the last 5 years. And of these, 191 were children. It is crucial that EU countries improve search and rescue practices to save lives at sea. These 6 steps can prevent future tragedies: 🔴 𝗕𝗲𝘁𝘁𝗲𝗿 𝘀𝗲𝗮𝗿𝗰𝗵 & 𝗿𝗲𝘀𝗰𝘂𝗲: EU institutions and countries should agree to exchange search and rescue protocols and develop best practices. 🔴 𝗙𝗮𝘀𝘁𝗲𝗿 𝗶𝗻𝘃𝗲𝘀𝘁𝗶𝗴𝗮𝘁𝗶𝗼𝗻𝘀: the EU should ensure quick and independent investigations of all shipwrecks with help from human rights bodies. 🔴 𝗖𝗹𝗲𝗮𝗿 𝗱𝗶𝘀𝗲𝗺𝗯𝗮𝗿𝗸𝗮𝘁𝗶𝗼𝗻 𝗿𝘂𝗹𝗲𝘀 𝗮𝗻𝗱 𝗺𝗼𝗿𝗲 𝘀𝗼𝗹𝗶𝗱𝗮𝗿𝗶𝘁𝘆: the EU should include a special mechanism for people who were rescued at sea. 🔴 𝗕𝗲𝘁𝘁𝗲𝗿 𝗽𝗿𝗼𝘁𝗲𝗰𝘁𝗶𝗼𝗻 𝗳𝗼𝗿 𝘀𝘂𝗿𝘃𝗶𝘃𝗼𝗿𝘀: EU law should include shipwreck survivors who request international protection as an explicit category of asylum applicants with special needs. 🔴 𝗜𝗻𝗱𝗲𝗽𝗲𝗻𝗱𝗲𝗻𝘁 𝗯𝗼𝗿𝗱𝗲𝗿 𝗰𝗵𝗲𝗰𝗸𝘀: EU countries establish independent border monitoring mechanisms 🔴 𝗠𝗼𝗿𝗲 𝗮𝗰𝗰𝗲𝘀𝘀𝗶𝗯𝗹𝗲 𝗹𝗲𝗴𝗮𝗹 𝗽𝗮𝘁𝗵𝘄𝗮𝘆 𝘁𝗼 𝘁𝗵𝗲 𝗘𝗨: governments should provide accessible legal pathways to people who need international protection, for example by increasing places for resettlement and promoting other humanitarian admission programmes. The International Organization for Migration reports that 2023 was the deadliest year for migrants crossing the Mediterranean since 2018. "Pooling" "at the European level" migrants' applications for return passes to third countries or "developing cooperation" between States for the implementation of these procedures in order to "optimize" the chances of obtaining them in the context of the implementation of the Migration and Asylum Pact? Each Member State has privileged diplomatic relations from which it could benefit the community. Similarly, the EU has a diplomatic network that could be useful in facilitating the obtaining of these documents essential for return. Isn't the issuance of laissez-passer "crucial" for an "efficient" "return policy"?
