There is a better way! “Amy Fischer, the Director of Refugee and Migrant Rights at Amnesty International USA, said in a statement that Biden’s actions “set a dangerous international precedent.” “It’s deeply disappointing to see President Biden so hellbent on dismantling human rights for people seeking asylum and implementing policies that are plainly illegal under international and refugee law,” Fischer said. President Biden’s actions on Tuesday come as the numbers of unauthorized crossings in the U.S.-Mexico border have continued to go down in recent months, defying migration patterns. In April, U.S. Customs and Border Protection reported nearly 129,000 encounters (vs. 250K in DEC). Maribel Hernandez Perez, director of policy and government affairs for border and immigration at the ACLU, said Biden’s latest executive order will likely have a negative impact on the legal pathways of migration to the U.S. “Whenever you do anything that bars people from applying for asylum, what you're doing is in fact disrupting the legal pathways that people have,” Hernandez Perez said. The White House is finalizing plans for a “U.S.-Mexico border clampdown” that would shut off asylum requests and automatically deny entrance to migrants once a certain number of border crossings have been met. An expulsion power like this will bar people fleeing grave harm from even asking for asylum in the U.S., force them to wait in dangerous conditions, and exacerbate many of the current challenges we’re facing at the border. People arriving at the border have the right to begin the asylum process—regardless of where they are from, how they arrived, or how many people have arrived before them. However, our government continuously is making this process more difficult with unfair policies like this that only put people’s lives at risk. We call on the Biden Administration to reconsider and instead find a real solution and efficient way of processing people who are in search of safety. 2023 asylum trends from European Union Agency for Asylum – EUAA show: 🔵 Very high protection rates - Most asylum applicants in Europe have protection needs 🔵Increase to over 1 million - but these remain manageable numbers 🔵Recognition rates are high - most people arriving are in need of international protection 🔵43% at first instance for EU statuses (refugee protection and subsidiary protection) 🔵Then add humanitarian protections in national level- +50% cases have protection at first instance 🔵Then, +30% of negative decisions were over-turned on appeal 🔵Unsurprisingly, the 2 main countries of origin are again Syria and Afghanistan. Important to note about the report: 👉 National humanitarian protection statuses are presented as "negative decisions" = misleading. They are positive protection decisions. Many Afghans and Venezuelans receive these national protection statuses 👉Reference to "illegal" border crossings = misleading - it's called "irregular". Finally, numbers prove once again a continued unfair distribution across Europe because some countries 1️⃣ deny access to their asylum systems 2️⃣ refuse to comply with EU law ➡ These actions lead to increased responsibilities for other countries. The Department of Homeland Security has now released the final rule, 'Securing the Border.' As predicted, the FR seeks to maintain the various limitations and qualifications on asylum eligibility, previously established in other rules. DHS has claimed that the presumption of asylum ineligibility does not represent a categorical ban on asylum because it will necessarily be rebutted where "exceptionally compelling circumstances exist." Putting aside the fact that International Refugee Law does not require the existence of 'exceptionally compelling circumstances' as a necessary condition for the conferral of refugee status, the practical application of Circumvention of Lawful Pathways has not admitted such cases as exceptions. I have collected ample evidence from multiple interviewees that demonstrates clearly that the practice of Customs and Border Protection is akin to the imposition of a total ban on asylum eligibility, irrespective of circumstances, with occasional exceptions permitted for acute medical cases that cannot be treated in Mexico. I will be filing a comment on the FR, and I will ensure that it is published here when I do.

Europe’s controversial border policies, which aim to reduce irregular migration by outsourcing control to North African nations, are now showing grave consequences. While arrivals have decreased, the success masks stories of abuse and human rights violations at Europe’s periphery. As tens of thousands of migrants suffer in dire conditions, it’s clear that Europe’s approach risks deepening its dependency on authoritarian regimes while compromising its own moral stance.
