September 5: #AI #governance day! The Council of Europe has just opened its comprehensive #AI #Treaty for signature that has already been signed by several countries including the #EU, #UK, and #USA. This is the first-ever international treaty that legally binds countries to respect human rights, democracy, and the rule of law in AI usage. Highlights: * Global reach with it being open to non-European countries too. * Comprehensive Legal framework that covers the entire AI lifecycle, from design to decommissioning. * Risk management with a focus on minimizing potential harms while promoting responsible innovation. Developed by the Center for AI and Digital Policy (CAIDP), the treaty aligns with their mission to uphold fundamental rights and democratic values. I'd like to thank Gian Fabio Palmerini for bringing this document to my attention: it is the English version of the Original Chinese The Model Artificial Intelligence Law (MAIL) v2.0: https://lnkd.in/dAew4ceT. ✅ The Abstract: As #China's inaugural systematic Model Law on #ArtificialIntelligence, its second iteration anchors its discourse on foundational principles of AI governance or regulation, frameworks that catalyze innovation, a licensing and registry regulatory system predicated upon a negative list, and delineates the obligations of AI developers and providers, as well as associated liabilities and enforcement modalities. Furthermore, it delves into the institutional manifestation of innovative regulation, such as regulatory bodies and governance augmented by technical agility, and open-source and intellectual property rubrics. It endeavors to contribute to the global and comparative dialogue by elucidating key terminologies and institutional divergences pertinent to AI governance and offering a potential roadmap and pivotal points for AI compliance to multistakeholders. 🔖 I also found the first version of this document, which is available here: https://lnkd.in/d-AdJ374 Both versions are in the draft and suggestion stage. The second version builds upon the foundational principles established in the first one, incorporating additional elements such as innovative regulatory frameworks, licensing and registry systems, and a more explicit focus on developer and provider obligations. This updated version provides a more comprehensive and adaptive framework for #AIGovernance, setting a strong foundation for responsible AI development and deployment in China and serving as a reference for other countries developing their AI regulation #policies. ✅ Furthermore, I came across the "Artificial Intelligence Law (Scholar's Recommendation Draft)", which was released on March 18, 2024, by the Legal Science Frontier Public Account at the AI Governance Forum in Beijing. I will discuss this in a separate post: https://lnkd.in/d3XxRYWn The authors of the draft are a team of experts from various institutions in China, including universities, research centers, and government agencies (see 1st comment for more information). In my opinion, they did an excellent job by covering all the remarkable topics we have seen already in documents such as the #AIAct or the various #AIResponsible guidelines in this second version. I would like to highlight Article 11, "International Collaboration" 🌍 which at least on paper:"It participates in the formulation and implementation of international rules and standards related to artificial intelligence and promotes the development of an international governance framework and standardization norms for artificial intelligence that have broad consensus". #Laws #Regulations

Sharing for fellow legal translators (and everyone, actually!) 🤖 The website for the proposed EU Artificial Intelligence Act has a newsletter dedicated to keeping you up to date with the latest developments and analyses of the proposed Act. The website itself also offers a wealth of information surrounding the proposal and the different #AI risk categories, including the prohibition on certain AI systems that are deemed to be dangerous. I'm hoping the newsletter will help me to keep up to date as I prepare to work on projects involving the translation of commercial AI policies in line with the new EU Act, which should come in to force in 2025. An interesting and important #AI update of June 7, 2024: #CNIL, France has published its first recommendations on the development of #AISystems. Aim is to create balanced ecosystem of #ResponsibleAI where innovation is done keeping rights in view, particularly #privacy rights. After public consultations, they have created systematic initial "AI How to Sheets" on aspects such as Legal Regime for AI Providers, Lawfulness of Data Processing etc. This in my considerate view, is a 'lean yet rich' #AICompliance guidance model, from which other jurisdictions may as well draw inspiration and create local and regional versions with domestic law customizations.
