The regulations governing surrogacy in India have gone through numerous changes over the past few years. While the Indian Surrogacy (Regulation) Act, 2021 is progressive in many aspects, it currently excludes LGBTQ couples. Several other countries have more inclusive laws that allow all individuals, regardless of sexual orientation, to pursue surrogacy as a means of starting a family. Recently, surrogacy was prohibited for Italian citizens, including where they engage in surrogacy overseas. Today we see news that an Italian couple trying to leave Argentina with their baby were arrested as they tried to leave Buenos Aires. It is unclear whether they were arrested because of their Italian citizenship, or, as is reported, due to the focus on an 'organisation allegedly exploiting women.' Criminalising surrogacy does not protect the interests of children born or the surrogates. What happens next? How can it be that arresting these parents leads to better outcomes for the child or the surrogate? Surrogacy should be regulated, and for everyone's interests, it should be accessible at home. Cross-border surrogacy in poorly regulated jurisdictions inevitably involves exploitation, and the profit-makers will simply find another destination when this one no longer suits them. #surrogacy #Italy #Argentina
