Is there? So, so for litigation and arbitration what we try to tell the client to do as early as possible because we have this problem with in-house counsel is to have a a protocol have some sort of protocol so that you mark start marking the the, the documents with with some heading you know like the litigation privilege or something so that you you. And separate them from the from the rest. And the other thing is to alert management I think to to the fact that there is this privilege that can be lost in house because a lot of the the the operations people are very big on you know WhatsApp and passing advice that they've got from the inhouse legal all around and and you know you lose something in the paper trail. So once you have a protocol and once you have some. Idea that everything that's being penned down is inherently discoverable, then that will probably manage the communications. Then of course you have your search functionalities because once you try and separate your privileged documents and once you start having a marking system, it's easier to to then pull them out.

In Malaysian Law, You Can Enforce A Promise Even If You Didn't Give Anything In Return! 😲💼In English Law consideration must move from the promise i.e the person who receives the promise must himself give something in return. In Malaysia a party to an agreement can enforce a promise even though he has given no consideration, so long as somebody else has done so – Section 2(d). The Eleos Anti-Death Penalty Clinic took a group of #MonashLaw students to Kuala Lumpur, Malaysia, for a unique opportunity to engage deeply with the complex and sensitive field of death penalty law. This is the first international In-House Clinic in #MonashLaw's Clinical Legal Education program The students engaged in detailed casework, assisted pro-bono lawyers on death penalty cases, and observed proceedings in the Federal Court of Malaysia. At the same time, "the program allowed us to build meaningful connections with local legal practitioners, fostering cross-cultural understanding and collaboration," said Nisaha.
