In today’s article, Economou & Co LLC examines the opinion issued last Thursday by Advocate General Tamara Ćapeta, which, if adopted, could have far-reaching implications for sports arbitration. The case before the Court of Justice of the European Union involves Royal Football Club Seraing and Doyen Sports challenging FIFA’s ban on third-party ownership (TPO) of players’ economic rights. FIFA sanctioned the club, a decision upheld by TAS/CAS Tribunal Arbitral du Sport / Court of Arbitration for Sport / Tribunal Arbitral del Deporte and the Swiss Federal Supreme Court. Now, the CJEU must determine whether national courts should have the authority to fully review CAS awards for compliance with EU law. AG Ćapeta’s opinion strongly argues that national courts must have full judicial review authority over CAS rulings to ensure FIFA’s regulations align with EU law. 📌 Key takeaways from the opinion: 🔹 CAS rulings should not be immune from judicial review, as FIFA’s arbitration system is mandatory rather than voluntary. 🔹 FIFA enforces its rules independently, making national court oversight essential to safeguard competition and economic freedoms. 🔹 A ruling in favour of national court review could redefine the balance between private sports arbitration and public legal scrutiny. 🚨 CAS awards not final anymore?🚨 Advocate General’s Opinion in Case C-600/23 - Sports Arbitration Advocate General Ćapeta draws a clear distinction between sports arbitration and commercial arbitration and further suggests that rulings by the Court of Arbitration for Sport (CAS) should be fully reviewable by national courts to ensure FIFA’s regulations align with EU law. If the CJEU adopts the AG’s position, it would grant EU sports entities, who are subject to FIFA’s dispute resolution system, the right to challenge FIFA’s rules in national courts, regardless of a final CAS award. This would provide a mechanism for judicial review of FIFA’s regulations under EU law. #arbitration #sportslaw

⚖️ Court of Arbitration for Sport Awards to Face Full Judicial Review by National Courts? ⚽ In today’s opinion, AG Tamara Capeta proposed that awards by the Court of Arbitration for Sport (#CAS) must be subject to full judicial review by national courts to ensure compliance with #EUlaw. The Court of Justice of the European Union Case C-600/23 concerns a contract between Belgian football club RFC Seraing and Maltese company Doyen Sports for the transfer of economic rights of several players. FIFA’s Disciplinary Committee found the contract in breach of its rules prohibiting third-party ownership of players’ economic rights and imposed disciplinary measures, which were later upheld by TAS/CAS Tribunal Arbitral du Sport / Court of Arbitration for Sport / Tribunal Arbitral del Deporte and the Swiss Federal Supreme Court. In a passage with implications far beyond this specific dispute, the AG drew a clear distinction between sports arbitration and commercial arbitration, highlighting two key differences: 1️⃣ Consent: In commercial arbitration, the arbitration clause is freely accepted by both parties, justifying limited judicial review. Conversely, FIFA’s system imposes mandatory arbitration via CAS on its members, limiting their autonomy. 2️⃣ Self-Sufficiency: FIFA’s dispute resolution system enforces arbitral awards independently, without need for judicial enforcement. For instance, sanctions can directly prevent players, clubs, or associations from participating in competitions. According to AG Ćapeta, these characteristics necessitate direct and full judicial review to safeguard compliance of #FIFA rules with EU law.
