Recently, the healthcare industry saw the largest medical malpractice verdict in the history of the United States. Although juries that award large sums to plaintiffs may feel concern for an injured person, 40 percent or more of that indemnity can go to the plaintiff’s attorney, not the plaintiff. Nuclear verdicts create ripple effects that spread far beyond the parties to a medical malpractice lawsuit. Eventually, premiums for medical professionals are affected, and increases in premiums for healthcare professionals can affect the cost of care. According to the International Commission on Radiological Protection (ICRP), the three fundamental principles for radiological protection are: 1. Justification: Any decision that alters the radiation exposure situation should do more good than harm. This means that the benefits of the activity that causes the exposure should outweigh the associated radiation risks. 2. Optimization of Protection: The likelihood of incurring exposure, the number of people exposed, and the magnitude of their individual doses should all be kept as low as reasonably achievable (ALARA), taking into account economic and societal factors. 3. Dose Limitation: The total dose to any individual from regulated sources in planned exposure situations, other than medical exposure of patients, should not exceed the appropriate limits recommended by the ICRP. These three principles - justification, optimization, and dose limitation - form the foundation of the ICRP's recommendations for ensuring the safe use of ionizing radiation in various applications.

As medical physicists the first concern of us is the safety of the patient from the radiation exposure and also protect ourselves from the radiations . The three principles of Radiation protection: --> justification --> optimization --> Dose limits justification: the radiation exposure is in such a way that the benefits of the exposure overweigh the harm from exposure optimization: it involves the ALARA (as low as reasonably achievable ) and AHASA( as high as safely achievable) principle . Dose limit - the exposure should be with in the dose limits prescribed by the AERB Or ICRP

A common assumption in facilities using ionizing radiation sources is that the existing shielding and/or the distance to occupied areas are in compliance with state and federal regulations for radiation dose limits for the public. But that may not be the case. In this article, you’ll learn what public dose is, how to measure it, and the regulatory bodies who ensure compliance. The phrase "nuclear verdict" strikes fear into the heart of any medical defendant. Today we're tackling it head on in the Doctors and Litigation podcast. Dusty Otwell, JD, medical malpractice defense attorney and Chief Risk Officer of UCACS, joins me to discuss “nuclear," "runaway jury," or aberration verdicts. These tend to make headlines, create fear among doctors and other providers...and lead other parties to dream of giant jackpot winnings. In this episode we discuss: • Societal trends that may be fostering the increase in aberration verdicts • How we can mitigate our fear around the possibility of an aberration verdict • What happens after an aberration verdict: post-trial negotiations, and real-sizing the risk to your personal assets • Why defendants should feel empowered to speak up, request preparation, and ask for 'financial risk estimates' • The ‘reptile theory’ deployed at trial by plaintiff’s attorneys, and how tapping into the general anger in society fuels their persuasion • Why and how defense teams need to evolve to combat these tactics • Why now, more than ever, preparation of the defendant should be paramount and start EARLY in the case.
