On November 13, the European Commission proposed a single digital declaration portal to streamline the process for companies temporarily sending workers (posted workers) to other Member States. This initiative aims to reduce the administrative burden on businesses while maintaining high protection standards for workers. Key Highlights: 1. I have recently been undertaking diligence around "Misclassification of employment" in preparation for some client work. This is important for those who regularly use #Contractors (who might resemble #Employees), particularly for long periods of time ... The #EU has been debating how to tighten up rules surrounding #Misclassification and the use of #algorithms in the workplace, for those working through digital labour platforms (e.g. Delivery and Taxi Services), and I wanted to share what has recently been approved by the Council in the #PlatformWorkDirective (#PWD) (European Parliament is due to vote on the DRAFT next month). This is a useful reference point, as clearly Members States (sovereign jurisdictions) all have vested interests and differing opinions and you can see that with the EC's "intent" to ensure that Workers Rights are consistently applied, Members states will still be able to fall back on National laws, Collective Agreements and Case law (as now) in situations where there is debate on whether a Worker is indeed an Employee, or not. So, there are correct principles in place by the EU, but remain conscious that Members States all have local nuances and practice to balance.
