December 10th is #InternationalHumanRightsDay, commemorating the date the landmark Universal Declaration of Human Rights (UDHR) was proclaimed by the United Nations General Assembly in Paris, 1948. Here at Best Interests, we stand behind the creation of a federal Human Rights Act, to protect the fundamental rights of all Australians. Today, we consider the impact of human rights in our everyday life, the importance of promoting and safeguarding them for our national community and for our children’s future. Today, 10 December, is Human Rights Day. Today, and every day, the ALA affirms that human rights are inalienable, universal and protect human dignity. They are based on centuries of common law and widespread international consensus. We continue to push for the legislative strengthening and protection of human rights in Australia at the state and federal level. While human rights legislative instruments exist in the ACT, Queensland and Victoria, none such exist in the other states and territories. Australia remains the only Western democracy without a federal Human Rights Act, Bill of Rights or Charter of Rights. To understand health disparities experienced by Indigenous people, it's critical to understand the key and unique drivers of health that underpin the disparities. Some determinants are common across all populations in Canada, including education, employment and income, and food security. However, others are quite unique to Indigenous people and must be considered when planning systems and supports for Indigenous people. These unique determinants include colonization and colonialism, child welfare policies and systems, and environmental stewardship. Embedded in the Indigenous social determinants are other critical elements, including taking a lifespan approach to our work, and the understanding that some determinants are more root cause, others are more systemic, while others are more down stream. It's so important to use Indigenous conceptions of health, wellness, and illness when trying to understand a problem. For instance, if we just used the conventional determinants of health to assess disparities and find solutions, the solutions we arrive at risk not addressing the unique drivers of health in favour of a more generalist approach, which we know does not work. If you're looking for a document that provides an excellent overview the key drivers of Indigenous Health, I would encourage anyone to give this a read.

In a new Current Perspectives article in the Australian Journal of Human Rights, I look at the guarded potential of the Federal Parliamentary Joint Committee's Inquiry into Australia's Human Rights Framework which offers the opportunity for ambitious reform of Australia's more than a decade old Human Rights Framework, including through the long overdue enactment of a Federal Human Rights Act.
