Faculty scholarship spotlight! #uhmlawschool Prof. Melissa Stewart received the 2023 AALS Section on International Law inaugural New Scholars Award for her article, Cascading Consequences of Sinking States. In Cascading Consequences, Prof. Stewart examines the phenomenon of sinking states—low-lying island states at risk of the submergence of the entirety of their territory due to sea level rise—and offers a novel perspective on what the existence of sinking states reveals about cracks in the foundation of international law. 🔗https://go.hawaii.edu/yLN

[WATCH] Inaugural Lecture of Prof Karin van Marle Date: 24 October 2024 Time: 18H00 - 19h30 TITLE: ‘Taking up office’ Jurisprudence, space, place, interpretation, cohabitance I subscribe to the view of Jurisprudence as the ‘consciousness’ and ‘conscience’ of law, law’s knowledge and law’s conscience (Douzinas and Gearey 2005) . Related to this view, I approach jurisprudence ‘as a public art obliged to care for law’s forms and methods’ (Genovese 2022). What does it mean to take up the office of the jurisprudence in a specific place, at a specific time - this space and time being South Africa after the ending of institutional legitimised exclusion and oppression, which is also a time and place of its endurance, socially? What does Jurisography, as a practice that is concerned about ‘jurisprudence writing’ belonging to ‘a tradition of conduct’ mean, and entail in such a place and time? In my address I aim to reflect on the role of space and place in giving meaning to, in interpreting law. Drawing on insights in spatial theory about the production of space and theorists on temporality, I argue for a spatial and temporal reading of jurisprudence, and constitutionalism. The historical self-consciousness of the constitution, underscoring the importance of time, space and place, should not only be heeded but should guide every act of interpretation. Interpretation as augmentation and translation, but also as recollective imagination will be unpacked. Ethical feminism and the emphasis it places on difference has been central to my work over many years. The right to difference is also at the heart of the spatial theorist, Henri Lefevbre’s notion of the ‘right to the city’. I aim to place difference, interpretation and cohabitants next to each other in my reflection on the office of the jurisprudent, of someone teaching and doing research in the field jurisprudence at the University of the Western Cape, as the university for the left. #IamUWC #UWCLaw https://lnkd.in/dyt9bDBC

Based on my doctoral research at the Faculté de droit - UNIGE, the work is coming out as part of the Oxford Monographs in International Law series and strives to give a comprehensive but accessible overview of the phenomenon of recognition of States in contemporary international law. LATEST PAPER: "The European Union as a Form of ‘Functional Federalism’", Perspectives on Federalism, 2024. In this article, I have sought to elucidate why Peter Hay's foundational text, "Federalism and Supranational Organizations" (1966, https://lnkd.in/d53xMFg7), merits renewed attention from those studying EU law. Indeed, it is a seminal work that is, paradoxically, surprisingly under-cited in contemporary scholarship. https://lnkd.in/df9YZb8E

Last week at the Honours Academy - Leiden University Laurens van Appeldoorn gave a guest lecture in the course The Role of International Actors to Tackle Global Inequality with students from Law, International Relations, Social studies among others. In this lecture, he addressed the need to challenge value creation in the #GlobalValueChains to ensure #fairness. He discussed the article coauthored with Allison Christians. Laurens as a coordinator of our minor on #tax and #society Leiden Law School also introduced how these topics should be addressed in a multidisciplinary and collective way. Global Challenges should be addressed taking into account fairness and legitimacy. More information on the Minor and how we can address these challenges at https://lnkd.in/eKfcVWhj Leiden University

🔎 EU Values under the Microscope 🌍 I am excited to share my latest blog post, co-authored with Dublin City University's Professor Federico Fabbrini, on the 2024 Rule of Law Report, published as part of the Horizon Europe REBUILD project. In this piece, we critically analyse the latest European Commission's annual Rule of Law Report 2024 and discuss how it tries to spotlight both progress and persistent rule of law challenges within Member States. The report reveals the pressing need for accountability to uphold EU values, from judicial independence (Poland) over anti-corruption measures (Hungary) to media pluralism concerns (Italy). 📖 Read the complete analysis here: https://bit.ly/4fVrv8e

On 31 May 2024, I defended my thesis entitled " The Citizen’s Rights Directive, the Principles of Good Administration and the Implementation in Portuguese Law A Comparative Study”. The main focus of this thesis is the Citizens' Rights Directive, its implementation in Portuguese law and its relation with the principles of good administration and other related principles of the European Union. This thesis aims to analyse whether the implementation of the Directive in Portuguese law has been faithful to its purpose and to find out how it could have been improved by comparing the stipulations of the Directive and Portuguese law. With the defence of this thesis, I finished my Master's in European Legal Studies at Södertörn University College.
