Did you know you can’t copyright anything AI creates for you? That’s really important to know if intellectual property is important in your business. As an example, if you create a deck of oracle cards using art made by AI, you can’t copyright that deck – anyone else can replicate it and there’s little protection for you. Not yet had enough of racking your brains over artificial intelligence and copyright? Then I recommend shifting the focus away from training and protectability and towards copyright infringements in the output of generative AI systems. They can have a wide range of causes, for example the so-called overfitting phenomenon, in which the AI system is overadapted to the used training data. Who should be held responsible for such copyright infringements in the output of generative AI? I have discussed this in terms of liability theory and regulatory framework needs. News organizations have been inking licensing deals with AI companies—but they've done so while several copyright lawsuits against tech companies over their AI models are still playing out. 💣 Here's why that matters: a big question underpinning these lawsuits is whether using content without permission to train AI is "fair use." If courts favor the tech firms, it could shake up this freshly established licensing market. 🤔 As Michael Mattioli, an Indiana University intellectual property law professor, said: "Who’s going to be willing to pay for a license if you don’t need one?” ⚖ At the same time, the fact that licensing agreements have sprouted across the media landscape could make it harder for AI companies to battle copyright suits in court.
