It is uncertain whether the informal practice of multiple subcontracting still exists in the market!Typically, when securing elevator projects, owners or brokers often require the assignment of specific installation subcontractors, who in turn subcontract the work further, often to accommodate people from their hometown or friends. During favorable market conditions, the subcontractors listed in the contract and those actually performing the work can be two or three layers apart. This multi-tiered profit extraction has severely compromised installation quality, with experienced workers training novices and safety training being minimal at best. Everyone is rushing to complete the job and earn money, with little regard for safety. Improvements can only be achieved through diligent on-site safety inspections and fines. However, if safety inspectors are complicit, then safety largely relies on individual awareness.

What happens when TWO companies are at fault? In a recent court case examining an accident which could have ended in fatality for two workers, (but thankfully didn’t), it is important to understand what lessons can be learnt. As a manufacturer who is making lifting equipment, there’s a duty of care to ensure that everything is fit for purpose. As a company, you will be legally challenged if you have not completed all checks possible, and proven your equipment is safe to use. If a company hasn’t completed activities to understand operation in the environment in which they are selling for use, and failure happens, you are liable. As a company installing this equipment, you too are liable if an accident occurs due to the unsafe installation. In this case, the installer should have highlighted their safety concerns to both the supplier (manufacturer), and the end user (customer). By not ensuring the lifting equipment was safe for operators the installer had been fined too. Thankfully, the two men in the defective cradle didn’t pay with their lives when it fell 90ft, however they did suffer injury. Both companies were fined, which amounted to £240,000. The HSE inspector said, “The fines imposed on these two companies should underline to everyone in the construction industry the importance of ensuring rigorous safety checks are carried out on equipment before it is put to use”. Industrial radiography non-destructive testing (NDT) cabinets Following meetings with government legal advisers, the HSE radiation team have been authorised to change their interpretation of industrial radiography with respect to cabinets and the requirement to gain consent under the Ionising Radiations Regulations 2017 (IRR17), Regulation 7. It is felt that the new interpretation is now more proportionate and targeted. IRR17 definition: The IRR17 Regulation 2(1) states: “industrial radiography” means the use of ionising radiation for non-destructive testing purposes where an image of the item under test is formed (but excluding any such testing which is carried out in a cabinet which a person cannot enter). New interpretation regarding cabinets used for NDT that require consent: “a person being able to enter a radiography cabinet means a person being able to reasonably step into the cabinet and stand inside with the door closed.
