The long-standing legal battle between Bacardi and Pernod Ricard over the Havana Club rum trademark has taken another turn. A U.S. federal judge recently ruled that Cubaexport, the Cuban company partnered with Pernod Ricard, cannot sue Bacardi in the United States due to the ongoing trade embargo on Cuban goods. Pernod Ricard has been distributing Cuban-produced Havana Club worldwide, but Bacardi, which acquired the original Havana Club brand in 1995, continues to sell its Puerto Rican-distilled version in the U.S. The roots of this battle trace back to 1960 when the Cuban government nationalized Jose Arechabala SA, the original creators of Havana Club, without compensation. Despite decades of litigation, the U.S. rum market remains a lucrative prize, valued at $2.86 billion today, with projected growth to $3.6 billion by 2031. This courtroom clash is far from over, especially given the commercial stakes. While Pernod Ricard and Cubaexport hope for a favorable outcome, Bacardi remains firm in its position as the rightful owner of the trademark. A bit of experience from the dairy... In the 1990s, a successful business thrived in Ukraine: national rankings and contests. Organizers of these contests or representatives of trade magazines would meet with the heads of food enterprises and offer them a top spot in the rankings - for a fee, of course. There was also a never-ending supply of independent consumer goods experts. They evaluated products like butter, for instance, and then, on morning shows aimed at housewives, the hosts would present these rankings to audiences of millions. Unsurprisingly, the scores and rankings often depended on the size of the sponsorship. I believe a profitable business model never truly disappears. So when I see endless award plaques on IT company websites, I can't help but think of the dairy company ratings and the contests deciding which butter was best to buy.

Going into this, some of my colleagues were concerned that being part of a conversation that goes into the recent events of chili crunch could paint a bad picture for our brand. I don't think that's the case. Why? It's important that we have discourse about the challenges that we can face as F&B founders. Patents aren't really at the forefront (depending on the product) – it's trademarks. When trademarks are subversively used to bring other brands down, especially the use of generic names, it can effectively put others out of business. But how did we get here? What was the strategy behind going after smaller brands? To create barriers to entry? To obtain competitive advantage? What is the direction of the CPG F&B space now that Pandora's box is opened? This isn't the first rodeo the AAPI community has gone through when it comes to trademarks. And it sure won't be the last. I'm grateful and thrilled to be part of this conversation with Ramon Vela, host of The Story of a Brand Show and Michelle Tew, Founder and CEO at Homiah and I hope we can find answers to this.
