Delhi High Court Issues Dynamic Injunction to Protect Copyrighted Works of Major Entertainment Companies
In a significant ruling, the Delhi High Court has issued a dynamic injunction to safeguard the copyrighted content of international entertainment giants such as Warner Bros., Netflix, and Disney. The injunction aims to prevent 45 rogue websites from unauthorized streaming and distribution of motion pictures and television series.
Justice Saurabh Banerjee presided over the case, which Warner Bros. Entertainment Inc., Columbia Pictures Industries, Inc., Disney Enterprises, Inc., Netflix US, LLC, SBS Co. Ltd., SLL Joongagng Co. Ltd. and CJ ENM Co. Ltd brought forward. The plaintiffs alleged that these infringing websites were unlawfully hosting and streaming their copyrighted works without authorization or license.
In his judgment, Justice Banerjee described the situation as a manifestation of "hydra-headed" websites, referring to the growing trend of digital piracy, where websites stream and distribute copyrighted content illegally. He emphasized that misuse of technology can have far-reaching negative consequences if it is not used through legitimate channels.
The court warned that while technology may be a "boon" when used lawfully, its illegal use will inevitably turn it into a "bane." In a striking metaphor, Justice Banerjee compared the rogue websites to a young tree that, if left unchecked, would grow into a sprawling entity with deep roots. He stressed the importance of curbing such activities at an early stage to prevent further damage.
The court's dynamic injunction ensures that the defendants and any future infringers are bound to comply with the legal orders now and in the future. Failure to do so would result in legal consequences, and the court clarified that its orders must be followed in "letter and spirit."
This ruling is a major victory for international entertainment companies and sets a strong precedent for the fight against online piracy in India.
