DMC 2024, Small Business Training Series Adds Dates, and BOIR Legal Update

Defense Leaders Discuss Manufacturing Barriers and Opportunities at DMC 2024

Mr. Vic Ramdass, Ph.D, Principal Deputy Assistant Secretary of Defense for Industrial Base Policy delivered the Office of Secretary of Defense Keynote on Tuesday at the Defense Manufacturing Conference (DMC 2024) in Austin.

Following Dr. Ramdass' keynote, Mr. Farooq Mitha, OSBP Director, shared insights on critical issues facing the defense industrial base on a panel moderated by Ms. Jennifer Stewart, Executive Vice President for Strategy & Policy, National Defense Industrial Association - (NDIA). The "Defense Manufacturing Barriers & Opportunities" panel also included:

• Mr. Anthony Di Stasio, Director of the Manufacturing Capability Expansion and Investment Prioritization Directorate (MCEIP) at the Office of the Under Secretary of Defense for Acquisition & Sustainment.
• Mr. Chris Peters, U.S. Partnership for Assured Electronics (USPAE)
• Mr. Ethan Plotkin, CEO, GDCA

Court Temporarily Halts Beneficial Ownership Information Report Requirement

The U.S. District Court for the Eastern District of Texas granted a preliminary injunction to stop the federal government from enforcing the Corporate Transparency Act (CTA) that required businesses to file a Beneficial Ownership Information Report (BOIR) by the end of 2024.

Under the law, many U.S. businesses were required to submit a BOIR to the Financial Crimes Enforcement Network (FinCEN) or face fines of up to $592 per day. The BOIR required business information such as state of incorporation, mailing address, and EIN, among other data points.

The court’s order is a preliminary injunction only and not a final decision. It temporarily pauses enforcement of the CTA on a nationwide basis. Still, enforcement could resume if the order is overturned on appeal, or the government ultimately prevails on the merits.
