Making U.S. AI Safer

New Public Private Access Agreements to Protect Systems

Just four months after AI industry, academic, and critical infrastructure leaders joined to form Homeland Security's Artificial Intelligence Safety & Security Board, these leaders have signed an agreement giving the US AI Safety Institute (USAISI) critical access to major models from each company before and after they're deployed to the public. The move is an effort at government involvement to screen for threats, test current mitigation efforts, and identify new vulnerabilities that could be exploited by bad actors faster. The Institute is located within the National Institute of Standards and Technology (NIST)in the US Department of Commerce.

Alphabet Soup?

If all the agency names and acronyms sound like alphabet soup to you, you're not alone! While NIST has been around since 1901, it's grown in recent decades to a key federal agency under Commerce. The new USAISI is headed by Elizabeth Kelly, a Washington policy insider, former Capitol One VP, and Yale graduate, and lacks a technical background and is wrangling leaders with vastly different agendas.

Adding to the pressure for national action and the confusion, a patchwork of state bills in Colorado, Utah, Illinois, & New York. Colorado was the first to pass it's law in May 2024, targeting potentially discriminatory AI algorithms and "high-risk" AI. California's proposed legislation went to the Governor's desk after passing both houses the last week of August.

What it Means for SMBs

While the government works at the outer limits of AI to manage threats to national security and critical systems, small and midsized businesses face their own challenges in securing customer and company data from emerging breach and ransom threats. AI can be a valuable tool in phishing detection, behavior monitoring, and identifying and managing surging compute demands of new AI tools.
