  • Pannu Lawyers recently prepared and responded to a matter at an interim hearing concerning a young child in the primary care of her mother regarding issues including time and travel. Issues of overseas travel to India being an issue that should have been resolved between the parties but none the less came to Court for judicial determination amongst other parenting issues. In this case, the parties were both permanent residents of Australia having family and connections in India. Both parties similarly had strong ties to the Australian community having lived in the country for some time, being in paid employment in Australia and holding interest in assets in Australia. In this case, the Father had travelled to India several occasions whilst the Mother was prevented from travelling by virtue of having no option to travel to India without the Child in absence of consent. SJR Osmand commented that India is not a Hague convention country and is unlikely to be a Hague convention country soon. The Mother on an interim basis has been allowed to travel twice in a year subject to compliance with certain pre-requisite orders.

  • Recently our client was charged with common assault under section 61 of the Crimes Act 1900, which carries a maximum penalty of imprisonment for 2 years. For more information on the offence of common assault, refer to https://lnkd.in/gSF9EfSt. The Police also made an application for an Apprehended Domestic Violence Order (ADVO) for 2 years. However, after extensive negotiations with the police, we were able to reduce the duration of the ADVO to just 12 months. This was a significant reduction for our client, especially since it is conventional for a final ADVO to be made once there is a plea or finding of guilt. Our team thoroughly prepared our client’s case to present the best possible case before the Court. Despite the serious nature of domestic violence charges, the Court agreed with our submissions and dismissed the charge under section 10(1)(a) without recording a conviction. This means our client avoided having any conviction on their criminal record despite their plea of guilty.   • Last week, we appeared in a challenging matter at the Parramatta Local Court where our client was charged with intentionally/recklessly destroying or damaging property under section 195(1)(a) of the Crimes Act 1900, carrying a maximum penalty of imprisonment of 5 years and excluded person failing to leave premises when required under section 77(4) of the Liquor Act 2007, which prescribes a maximum court-imposed fine of $5,500. Our team put in extensive efforts in favour of a lenient sentence reflecting the Court’s approach to individualised justice whilst balancing the relevant factors and purposes of sentencing.
