On 26 July 2021 a 44-year-old worker sustained serious injuries when he was struck by a compact skid steer track loader (bobcat) at a worksite in Bundanoon NSW. Troy Justen Adams was the sole director and secretary of TBN Civil Pty Ltd which was engaged to conduct the construction work at the site including widening a section of road. To widen the roadway, a bobcat was used to grade the road base. At various times during the day, a worker would need to enter the newly widened roadway to measure its elevation using a handheld device. Mr Adams failed to exercise due diligence to ensure TBN Civil Pty Ltd had a safe system of work for the task of widening the roadway which adequately addressed the risk of workers being hit, struck, or crushed by the bobcat. Mr Adams entered a plea of guilty to an offence under sections 32/27 of the Work Health and Safety Act 2011 and was fined $30,400. Mr Adams has the right to appeal this sentence. #SafeWorkNSW #Prosecution

On 21 September 2021, a 50-year-old worker sustained serious injuries when he was struck by a Hydro Vac Truck in Marchmont NSW. The Hydro Vac Truck was being used to excavate holes for road signs. The truck had the controls for the Hydro Vac fitted to the rear passenger side in front of the passenger side wheels. This area of the truck was not viewable to the driver. To install signs, the worker would use the hydro gun and vacuum at the rear of the truck which was operated by the control panel. The equipment would be returned to the vehicle, and the truck would move forward to the next location on the road There were no cameras installed to the truck to assist the driver’s visibility. There was no documented system in place to warn pedestrians of the impeding movement of the truck nor were there any visible or audible alarm or horn to alert persons of the truck’s movements. Capital Lines and Signs Pty Ltd entered a plea of guilty to an offence under sections 32/19(1) of the Work Health and Safety Act 2011 and was fined $38,000. DNA Rooftiling Services Pty Ltd was charged with one offence for failure or refusal to respond to a SafeWork NSW notice without a reasonable excuse and fined $4,000. On 9 May 2022 an incident occurred where a worker sustained serious injuries when the alfresco roof area he was working on collapsed beneath him. SafeWork NSW investigated the circumstances of the incident and as part of the investigation had reasonable grounds to believe DNA Rooftiling Services were capable of providing SafeWork NSW with information, evidence or documents. After service of a Section 155(2) Notice, and approval of an extension to the notice, DNA Rooftiling Services did not provide any response, information or documents to SafeWork NSW. DNA Rooftiling Services to date have not provided any response to the Notice or provided a reasonable excuse for not responding. DNA Rooftiling Services Pty Ltd have the right to appeal this sentence.
