The Court of Justice of the European Union (CJEU) has again upheld the supremacy of legal professional privilege over national disclosure requirements pursuant to EU Council Directive 2011/16/EU. The Court found that legal advice provided by a lawyer in company law matters falls directly within the scope of Article 7 of the Charter of Fundamental Rights of the European Union, and national legislation requiring a lawyer to disclose this confidential information constitutes an interference of those rights.
