How much is it going to cost a New Zealand business to become an Accredited Employer? Visa application fees are a necessary expense when dealing with Immigration New Zealand. The previous work visa scheme placed most of the expense on the migrant. However, the current Accredited Employer work visa scheme places part of the burden on the New Zealand business. For most New Zealand businesses, before offering a role to a migrant, at a minimum, they must submit two separate applications with Immigration NZ: 1) An Accreditation application; and 2) A Job Check application. Each of these applications comes with a cost. Immigration New Zealand's Accreditation application fees will depend on the type of accreditation you are seeking - Standard, High-volume OR Controlling third party. Whereas the Job check application fee is fixed and is the same whether you are seeking to fill 1 vacancy or 100 vacancies in a single job check application. Note that different roles will require separate job checks. Once a job check is approved - the applicant (or the migrant) will need to submit their own Accredited Employer Work Visa application (the third step in the process). This comes at cost of $1540NZD. Given the significant financial impact on your business, it is important to get things right, the first time. #ImmigrationNZ #AccreditedEmployers #TheMigrationist #NZimmigrationlawyer #NZImmigration

Did an AEWV holder resign recently? As an Accredited Employer, you have an obligation to inform Immigration NZ (INZ) within 10 working days of their departure. The quickest way to inform INZ is via Immigration Online: ✴️You can either do this yourself; OR ✴️ If you are represented by a Lawyer or Immigration Adviser, they can do it for you. *️⃣Only applies if your Accreditation status was approved, renewed or upgraded on or after 7 April 2024. Feeling the pinch? Starting 1 October 2024, Immigration New Zealand is hiking application fees, with some increasing by over 50%! While the increase to Accreditation & Job Check application fees is minimal, individual applicants are set to face the most impact. It is crucial, now, more than ever, to ensure your application is thoroughly prepared and decision-ready. Plan ahead! Announcement for Partners and dependent children of AEWV visa holders. If you hold an AEWV for an ANZSCO skill level 4 or 5 occupation, you can no longer support your partner or dependent children for visas! They must qualify on their own. This obviously does not impact those who are already in New Zealand on a dependent visa or those with applications in process. There also seems to be an exemption for those on Level 4 or 5 roles with a pathway to residency. More to come...once the the official rules are released. #NZimmigration #ImmigrationLawyer #NZlawyer #Themigrationist #AEWV #Partnershipbasedvisa #WorkVisa

Your lawyer needs to be your biggest defender! Let us explain 👇 🟢 Our firm recently had a client referred to us. 🟢 The client was unlawful and his previous representative had advised him that he had no options left and that he should leave the country. 🟢 Once we found out that he had a young child permanently residing in NZ, we immediately knew we had to help him. 🟢 Having reviewed his file we realized that his previous representative had given up too early! 🟢 In fact, the steps taken by the previous representative were not entirely in the best interests of the client. 🟢 Given his unlawful status, we urgently submitted a new visa request for our client and negotiated with Immigration NZ to halt any deportation action until a decision was made on our request. If our client had not sought a second opinion, he would have never been aware of all his options. Moral of the story: Find yourself a lawyer who always acts in your best interest and finds the solution in difficult situations. #immigrationlawyer #NZimmigration #NZlawyers #ImmigrationNZ #immigrationNZ #TheMigrationist

Do you know the current average processing timeframe for a Job Check application? It is 9 weeks. Job check applications can take a long time to process, impacting your ability to meet your staffing needs. On 7 April 2024 additional requirements were introduced into job check policy. Now, one of the most important steps for an employer is determining the skill level of their vacancy, as this impacts where and how they need to advertise the role. •Skill level 1-3 vacancies need to be advertised for a minimum period of 14 days (for example on Seek or Trademe); whereas •Skill level 4-5 vacancies need to be advertised for a minimum period of 21 days + the employer must engage with Work and Income NZ. This means that most employers will need to plan their recruitment several months in advance to allow sufficient time for advertising and the subsequent processing by Immigration NZ. A decision-ready application will ensure you are submitting an application to Immigration New Zealand which meets all of their policy requirements, avoiding unnecessary delays. This is where we can help! Contact us today to discuss your business needs. #TheMigrationist #NZimmigrationlawyers #NZimmigration #ImmigrationNZ #NZlawyers #AEWV #JobCheck #AccreditedEmployers

A raft of changes were introduced yesterday in respect of the Accredited Employer Work Visa/Job Check policies. Most of these changes were targeted towards lower-skilled workers (ANZSCO occupation code 4-5 roles). The key points for employers (applying for Job Checks for lower-skilled occupations) and migrants applying for work visas based on those Job Checks is set out below. Remember these changes will apply to any application (Job Check OR AEWV) submitted on or after 7 April 2024. Note: English language requirements can also be met in other ways.
