With more than 80 attendees in the room and more than 150 joining virtually, it was a truly inspiring day of collaboration and innovation. Joining everyone else posting about it - but today is the big day! 💥 Genuinely so exciting to see this finally happening, having been working with the Cabinet Office Government Commercial Function to shape this as part of their initial expert advisory panel back in 2019. I am - of course - most excited how the new Act can be a tool for driving innovation procurement. And how we can use it to modernise how we test and buy technology, especially AI. I have been working with friends from Innovation Procurement Empowerment Centre (IPEC) Innovate UK and elsewhere to pull together some guidance on how the new Competitive Flexible Procedure can be used to make procurement more innovative, agile, and...flexible. We'll be sharing something on this soon 👀 👀 Well done to Lindsay Maguire and the rest of the team for reaching this milestone - I am so excited to see how the sector can shape new procurement tools and approaches. Procurement Act 2023: Will ‘Competitive Flexible Procedure’ supercharge your public sector selling process? ⚡️ Johnny Hugill, Director of Commercial, Spend and Impact at our partner PUBLIC, calls Competitive Flexible Procedure (CFP) the “rockstar of regulations” and is the most significant change for suppliers in the new Procurement Act 🎸 The Act, set to go live on the 24th February 2025, will introduce the CFP, which gives contracting authorities the flexibility to design their own, more competitive, procurement processes 💡 The CFP will incorporate processes, commonly used in private sector sales processes such as negotiation at any stage (including pre-tender, open tender, or post-tender), an open risk dialogue with suppliers, or a product demo stage 🏎️ What’s changing under ‘Competitive Flexible Procedure’? ⚡ More flexibility for buyers: Contracting authorities can now design their own procurement processes, tailoring them to their specific needs and challenges. 🏆 More strategic competition: Buyers can limit suppliers at different stages, refine award criteria, and negotiate more effectively. 📉 Fewer procedural restrictions: Processes like Competitive Dialogue and Innovation Partnerships are being replaced, making procurement faster and more efficient. How should suppliers be preparing? 📖 Understanding buyer priorities: As buyers shortlist suppliers at different stages, suppliers must demonstrate value immediately and pre-engage opportunities early to stay ahead. 🛠️ Adapting bid strategies: Suppliers must prepare for multi-stage competitions, refining bids over time and engaging in negotiations to stay competitive. 📊 Leveraging new opportunities: With more flexible routes, suppliers who demonstrate value beyond cost will gain a competitive edge. 🌐 One month on from HMG’s ‘AI Opportunities Action Plan’ - How can the Government become a better buyer of AI capabilities? We were excited to see Department for Science, Innovation and Technology's plan outlining the potential of AI aligned with the Government’s Five Missions, and last week our Managing Director Ryan Shea joined an expert panel at Prolific’s Winter Summit to discuss PUBLIC’s thoughts! In particular, we were pleased to see DSIT arriving at a similar conclusion as we did in our ‘Buying GenAI in Government’ report from last August, noting the usefulness of ‘Contemplation Clauses’ in Recommendation 43 of the Action Plan. 🔍 But what is a ‘Contemplation Clause,’ and why is it useful for AI in government? One of the concerns we hear from buyers is that AI technology is moving too fast, so they are uncertain when is the best time to invest. That’s where the ‘Contemplation Clause’ mechanism comes in handy! It can be used to agree with suppliers during procurement (by being included in all major commercial documents) that the buyer expects the service it receives to keep pace with the ‘state of the art’. This commitment by both parties to ‘contemplate’ changes to the contractual arrangement protects the buyer in a situation where capability has dramatically improved since the initiation of the relationship.
