Alliance for the Adoption of Innovations in Medicine (Aimed Alliance) is a nonprofit organization that works to improve health care in the United States through access to treatments and technologies. Aimed Alliance achieves this mission by developing sound, patient-centered policy recommendations with a legal and regulatory focus; collecting information and providing analysis on patient access to novel medications, measuring the value of such treatments through the improvements to length and quality of life; and collaborating with like-minded patient and professional groups with complementary missions. We are thrilled to share that on December 21, 2024, New York Governor Kathy Hochul signed A.901A/S.1267A. This new law will impose reasonable guardrails on step therapy policies including: - Prohibiting off-label stepping; - Limiting step therapy to no more than 2 drugs; - Limiting step therapy to no more than 30 days or a timeline established by current evidence-based guidelines; and - Requiring plans accept a health care provider's attestation that a patient has tried and failed on a medication previously. The law will become effective January 1, 2026. Thank you to all the organizations, non-profits, and advocates who helped support this legislation! Prescription Drug Affordability Boards (PDABs) are state-based entities that review the cost of prescription drugs and attempt to address affordability concerns through price controls and other measures. However, these novel boards raise questions about how they define “affordability,” engage consumers, and how they will ultimately impact consumer’s prescription drug costs. AIMED ALLIANCE EDUCATIONAL SERIES: What Are Health Plans? Health plans are insurance policies that pay for some of your health care expenses. These expenses may include treatments, services, devices, prescription drugs, and more. There are several different types of plans you can choose from such as a Health Maintenace Organization (HMO); or Preferred Provider Organization (PPO). When determining which plan is right for you think of health insurance like any other type of insurance you shop for. For example, if you live in Florida, you might get hurricane insurance, but if you live in North Dakota, you probably need snowstorm coverage instead of hurricane insurance. Essentially, pick the plan that meets your needs and budget because your needs may be different from others. These questions can be tricky to answer. The Affordable Care Act (ACA) requires health plans to cover 10 Essential Health Benefits (EHB), however, health plans allege there is a loophole that allows them to deem certain prescription drugs non-EHB under the ACA. Non-EHB programs can delay or deny consumers access to medication and leave consumers paying thousands of dollars more per year than necessary. The Department of Health and Human Services has promised to issue a new rule clarifying the non-EHB designation is impermissible. However, the rule has not yet been released. Open enrollment began November 1, 2024, and closes December 15, 2024. If you are eligible for Medicare, you have until December 7, 2024, to pick a plan for 2025!
