Australian and New Zealand members of Dispute Resolution Board Foundation Region 3 got together for their final Breakfast Briefing for 2024 this morning. Today was technical, examining the pros and cons of separating liability and quantum opinions. Ron Finlay examined the High Court decision of CBI v Chevron and best practice when it comes to separating liability and quantum issues in advisory opinions. The session highlighted the flexibility of dispute boards to work together with parties to design the process that works for them, including early advisory opinions on narrower critical issues. In a recent announcement, the Abu Dhabi Projects and Infrastructure Centre | مركز أبوظبي للمشاريع والبنية التحتية (ADPIC) confirmed it has issued the updated General Conditions Contract for capital projects in the emirate, with the goal to advance procurement standards, dispute resolution and project delivery efficiency. ADPIC requires government entities to implement the revised Abu Dhabi General Conditions Contract (ADGCC) for capital projects, which includes the mandatory use of Dispute Avoidance and Adjudication Boards. ADPIC will also pilot Conflict Avoidance Panels (CAP) in their contracts. Maysarah Eid, PMP, Acting Director General of ADPIC, will open the DRBF MENA Regional Conference with a keynote address aimed to share details about ADPIC's role managing government capital projects in the emirate, and how Dispute Adjudication and Avoidance Boards will be implemented.
