    Two weeks ago, Particle filed an antitrust lawsuit against Epic. Today, the Federal Trade Commission commented they’ve heard these concerns, too, and went on to say, “Another concern we've seen is that when you consolidate control over data that can actually leave systems much more vulnerable to certain types of cyber attacks or other hacks that lead to systems really crashing.” We appreciate this community’s support as Particle navigates an unprecedented path to bring fairness, equity, and transparency to health data. I’m more confident than ever that this is the right action for better patient care.     Today, we are happy to formally announce joining the CommonWell Health Alliance’s Qualified Health Information Network (QHIN). This decision will allow us to deepen our partnership with CommonWell and work across the broader community to advance the goal of health interoperability under TEFCA. We expect to support exchange via TEFCA by the end of 2024, while continuing to support current network connections.     Today Carequality shared the final resolution of our dispute with Epic. This resolution—which finds no wrongdoing by Particle—vindicates our position: Epic’s claims were baseless. Epic has agreed to implement more transparency and open communication, with a six month oversight period to ensure adherence to this agreement. The increased transparency and clarity now required from Epic will benefit all participants and drive positive innovation for patient care. While the resolution sets the stage for more transparent health information exchange, it does not change our conviction in our antitrust complaint against Epic, and in fact strengthens it.  Everything we’ve seen shows that Epic’s actions during the course of this dispute served their own monopolistic business goals over the needs of customers and patients.     Today, Particle Health has taken decisive action to stop Epic Health Systems from blocking innovation, driving up costs, and most importantly—harming patient care. Over the past six months Epic has engaged in a multi-pronged campaign to destroy Particle and actively snuff out competition. In the process they’ve blocked their own providers from receiving patient records. As of today, September 23, 2024 we’ve filed an antitrust lawsuit in the Southern District of New York and an information blocking complaint with the federal government. Our goals are straightforward: first, we need to end the information blocking that's actively harming patients. Then, we need to ensure a level playing field where companies like Particle - but not just Particle - can continue to innovate, where providers and payers have choices, and where patients ultimately benefit from better, more efficient care.     Today, Particle Health filed a federal antitrust lawsuit against Epic. This lawsuit has high stakes for our company, the industry, and most importantly for patient care across the US. We did not make this decision lightly. However, after Epic’s clear abuse of power, we believe it is our responsibility to defend our mission, which drives innovation and ensures that patients receive an ethical and transparent quality of care. Over the past year, Epic has not only engaged in anticompetitive behavior but has purposefully blocked the exchange of patient information. Doctors need the full medical records of their patients, and this lawsuit represents more than just a business dispute. It's about medical ethics and protecting patients' rights to their health data.    We are committed to putting patients and caregivers first and to protecting competition and innovation in the marketplace. We know that in the long run, patients, providers, and health plans will benefit from having more competition, not less – just as we know that unchecked power over Americans’ medical records creates a situation ripe for abuse.
