  • Don’t Read This On Christmas Eve Hey, just your Tuesday Tip-- hope you are not reading this on Christmas eve. When someone says – “I got sued” or “I want to sue someone” – what does that mean? Short answer – it means going to court to resolve a dispute. There are really two parts – • finding the facts (using documents, witnesses, evidence) • applying the law to those facts (the court/jury will apply the law to those facts) A lawsuit is started with a document called a “Petition” which is normally served on the person being sued in person. Once a person “is sued” they will have a certain time period to answer the lawsuit. Once this happens – you are in the suit. If you have been sued, do not delay in getting an answer filed with the Court.

  • Nonprofit does not mean 501c3..unless. People call and would like us to form a “501c3” for them but may not understand the process. Let us clear the air. • First, you create and file a non-profit corporation with the Texas Secretary of the State. Once approved, you are a non-profit in the eyes of Texas but not a “501c3” in the eyes of the IRS. So, you are not able to give donors the ability to make tax deductible donations yet. • Next, you need to file an application with the IRS to become approved as a 501c3. There is a form called the 1023-EZ. This is typically a quicker way to get approved. To qualify you must anticipate having less than $50,000 average income for the first three years and must have less than $250,000 in assets at the time of application. • Once you complete and file the form with the IRS, they will review and hopefully issue you a favorable determination letter approving your non-profit as a 501c3. Then, donors can get tax deductions when they support you. PS. If you are a “Church”, speak with your CPA because you may not need to file with the IRS.

  • Let’s say you own a rent property or a commercial building but put the title in the name of “Apple Investments, LLC”. You get insurance for Apple Investments, LLC. Call your agent now and tell them to add your name to the insurance policy as an “Additional Insured”. PS. Summary – you should have a property insurance policy and liability policy with the beneficiary being Apple Investments, LLC and have YOU listed as an “Additional Insured’.

  • A professional employee of the school district (a teacher) is not personally liable for any act that is within the scope or incident to his/her position of employment and that involves the exercise of judgment/discretion on the part of the employee. This is called immunity. This immunity applies to actions in Texas state courts. Loss of Immunity If: the employee will be liable (will not be immune) if he/she uses excessive force or is negligent in the discipline of students. Not for Motor Vehicles: the immunity does not apply to the operation, use, or maintenance of any motor vehicles. A direct service volunteer of the school district has the same immunity unless the volunteer does something considered intentional misconduct or gross negligence. PS. A Note to Coaches—it is recommended that all activity associated with athletic training (like laps, pushups, etc) be assigned to students only for training or conditioning and not as punishment (which could cause a loss of immunity).
