As Singapore looks at reviewing our values, way of doing things and looking at new ways of progressing this week, how can we, lawyers look at the future with a new pair of lens? Humility: We are learned professionals. We can learn to appreciate our self-worth quietly whilst being empathetic to our associates, staff and fellow lawyers. We can be kind and tolerant. We are human beings first, before we are lawyers. Live and let live: We must remember that there is enough work and glory to go around. Kindness begets kindness. Let us view each other as equals. As lawyers, we are all good in our work, if not we we would not be in this honourable profession. Being a good lawyer does not mean we have to display aggressiveness towards our opposing counsels. We can show strength through gracious behaviour. Supporting our future lawyers: Practice of law is demanding and difficult. What kindness can we support to them in the career and future? In the midst of difficult clients and meeting the financial wellness of our law practice, let us treat them with humanity. Lead them by example. Nurture and mentor them. We are in a caring profession. We help clients to solve their legal problems, rebuild their life for themselves and their families. Without them, we are nobody. Let us put others before ourselves.

Eh, just take MC if your boss didn't approve your AL... Such creativity. Juvenile, but creative still. But did you know that you can face a disciplinary action for misusing your MC? Imagine this, You take an MC, but then you go to the mall, you're spotted by a colleague and it was made known to the management. OR, You couldn't get your AL approved, then you take MC instead to go to Phuket, post your picture on IG, and somebody at work saw those. OR, You take MC, and you went back to your hometown 300 km away, travelled back, and your manager caught wind of this. All these hypothetical situations (minus getting caugt) are called 'malingering'. And can be grounds for a disciplinary action which can contribute to a fair and lawful dismissal. Malingering betrays the trust the employer has put on you, it is an act of taking advantage by lying. Put it however you want it, it is what it is. Once a trust has been broken, it is hard to be mended. So, no matter how creative you are, or how confident you are that you will not get caught, please don't do this on your moral conscience. Have some virtue. Talk to your employer if you really need the leave, communicate, discuss. We talk about our rights as employees but forget about our responsibilities as one. #malingering #mc #cutisakit #labourlaws

"You can't work for our competitors 12 months after your last date here" Sounds familiar? Have you seen this in your offer letter? But, the important question is, is it legal? Or at least, is it enforceable? Well, if you're not employed in Malaysia, scroll away now, because this is specific to her. Experts will tell you there are a lot of nuances and precedents, and no definite answer could be given without any context. But generally speaking, no, this is not enforceable. Any agreement that prohibits a person to 'cari makan' lawfully, is void. So, this could be your offer letter, your contract of service, contract for service, engagement agreement; anything, and it would be void. BUT, beware, you still cannot use your previous company's trade secrets or disclose them to anybody else. You cannot in any way, maliciously act towards your previous company. This can be in the form of poaching their customers with the intent to do so. You might unintentionally blurt out 'stories' about your previous company that could harm their reputation, or considered as a trade secret, and this is something you have to be careful of. Whatever happened, happened. Use the experience and skills you gained to propel you forward but never badmouth or tell any information from your previous company, things such as their SOPs, tools, strategies, approaches, practices, and etc. If you didn't know before, now you do. #labourlaw #noncompete
