C Evans Scaffolding Ltd Decision of the 9th of January 2024   We could not let this decision pass without reviewing it given the name!   This is one of those cases which may have had a different outcome if the operator had sought advice.   3 key issues:   Handing in poorly prepared and incomplete paperwork creates an impression that you do not have good systems in place to manage your records   An acceptance that you are “learning on the job” is unlikely to be viewed favourably. Although the intention is to accept that you have made errors, there is an implied acceptance that you knew that you were falling short / lacked the requisite knowledge to run the lorries compliantly and did nothing to remedy that position. The case must be supported by evidence. It is often not enough to set out the position orally.
