ASAPRA Updates Its Leadership for 2025: Customs Broker Delegations from the Americas, Europe, and Africa Meet in Brazil The ASAPRA, the International Association of Professional Customs Brokers, held its 55th General Assembly at the Hotel Windsor Barra in Rio de Janeiro, Brazil, on November 11, 2024. Delegations of customs brokers from the Americas, Europe, and Africa gathered to discuss strategic issues, expand global representation, and update its leadership structure, effective January 1, 2025. Regional Changes and Global Expansion The assembly marked several transitions in regional vice presidencies, reinforcing ASAPRA’s commitment to renewal and integration of leaders. • Jose D. Gonzalez, Vice President for North America (NCBFAA), remains in his position. • José Carlos Raposo Barbosa, Vice President for the Southern Cone (FEADUANEIROS), will succeed Felipe Serrano Solar from Chile. • Carlos Alberto Aguirre Martinez, Vice President for Central America (ASODAA), replaces Wilfida Sandoval Alvarenga from Honduras. • Guillermo González Larsen, Vice President for the Andean Region (FITAC), will succeed Katya López Mena from Ecuador. • Salmate Chuaibo, Vice President for the African Continent (CDA), assumes the newly created role. This includes the National Committee on Trade Facilitation (NCTF) administered by the ABF and its sub – committees and advisory groups including the Compliance Advisory Group (CAG), the Trade Facilitation Initiatives Working Group (TFIWG) and the Trade and Technology Group (TTWG). This enables IFCBAA to advance the interests of members and report on industry developments. In recent time, there has been significant time spent at the NCTF, TFIWG and TTWG regarding proposed trade facilitation and modernisation initiatives including the establishment of the ABF’s Regulatory Sandbox. Further, at recent meetings of the CAG, there has been detailed engagement on the terms of Additional Conditions imposed on licensed customs brokers as well as proposed legislative changes to the framework governing licensed customs brokers in the Customs Act 1901. The next meeting of the CAG is approaching and the ABF has sought input from CAG members over various arrangements regarding outsourcing of some of the work behind the operations of a licensed customs broker. Specifically, the topic and input sought is summarised from the minutes from the last meeting of CAG on 27 March 2024 here. The item on which input is sought is highlighted below. CAG members to provide offshore business operations scenarios for Customs Licensing’s usage to gauge effectiveness and identify where further amendments to the conditions may be required. IFCBAA appreciates that there are a number of divergent views on the use of offshore business operations in the operations of a licensed customs broker and specifically this issue which is relevant to a number of Additional Conditions now imposed on members. IFCBAA would also appreciate some comments from members, being mindful that it needs to reflect the position of all IFCBAA members. We are excited to share that authorities from the International Association of Professional Customs Brokers (ASAPRA) and the Customs Brokers and Freight Forwarders Association of Jamaica (CBFFAJ) conducted a joint technical visit to the Port of Kingston, Jamaica. Welcomed by local customs authorities, this event reinforced international collaboration and the exchange of best practices in the customs sector. The main objective of the visit was to strengthen relationships between customs entities and provide a deeper understanding of the operations and infrastructure of the Port of Kingston, one of the Caribbean's main logistics hubs. During the visit, representatives from ASAPRA and CBFFAJ closely observed the control and customs procedures, the technologies used, and the strategies implemented to optimize the efficiency and security of port operations. Márcia Bent, President of CBFFAJ, highlighted: "The visit to the Port of Kingston allows us to learn from the best practices implemented here and adapt these solutions to our needs. This type of exchange is fundamental to improving our operations and ensuring a safer and more efficient foreign trade." Nelson Brens, representative of ASAPRA, added: "Strengthening partnerships between our customs entities significantly contributes to the harmonization of procedures and the facilitation of international trade. We appreciate the warm welcome from the Jamaican authorities and are eager to apply the knowledge gained in our daily practices." This technical visit also underscored the crucial role of customs brokers as global propagators of best port practices. The solutions and insights gained will serve as a model for other ASAPRA member countries, contributing to the continuous improvement of customs processes in the region. We look forward to continuing to promote innovation and efficiency in foreign trade!

🌐📦 Expanding My Industry Insight 🌟 I am immensely grateful to share that, over the past week, I had the privilege of engaging in an in-depth exploration of logistics intricacies particularly within the context of the Azerbaijan Customs System. This invaluable opportunity was made possible through the thoughtful initiative of my manager Aslan Kichiyev. Through insightful discussions and collaborative sessions with our esteemed third-party logistics partner North West LLC, I delved into a comprehensive overview of the Azerbaijan Customs System, laying the foundation for a profound understanding of its operational intricacies and regulatory framework. From there, we transitioned into exploring the organization of international transportation, where I gained invaluable insights into the critical documentation required for seamless cross-border logistics operations. Understanding the functions of these documents, including cargo classification and customs regulations, proved instrumental in grasping the complexities of international trade facilitation. One of the most enlightening aspects was the in-depth examination of main customs rules governing international transportation, as well as the principles and functions of customs control authorities in Azerbaijan. Navigating through Azerbaijan's customs legislation provided me with a comprehensive understanding of the legal framework underpinning customs clearance procedures. Moreover, these sessions equipped me with knowledge of legal methods for determining customs value, as well as the various types of customs tariffs, fees, and taxation structures Gaining knowledge about calculating customs taxes and following the guidelines for customs declaration forms and filing procedures has deepened my understanding of how customs clearance works. A highlight of this session was the exploration of the Customs Risks Evaluation system, commonly referred to as the "Green Corridor." This system underscores the importance of risk management strategies in optimizing customs clearance efficiency and mitigating potential bottlenecks. Lastly, gaining insights into customs brokerage functions provided me with a holistic perspective on the pivotal role played by intermediaries in facilitating smooth cross-border transactions. I want to extend my heartfelt appreciation to my manager Aslan Kichiyev for recognizing the importance of my professional development and arranging for this enriching opportunity. Additionally, my sincere thanks go to Humay Nasibova, for her expertise and commitment in delivering a comprehensive and insightful information. Egyptian Customs Authority Urges Shipping Agencies to Facilitate Goods Release at Ports Shipping Arabia, May 3, 2024 - The Egyptian Customs Authority, led by El Shahat Ghatouri, has issued a directive to shipping agencies and the Chambers of Shipping, urging them to facilitate the release of goods at ports swiftly. This action aligns with the Prime Minister's directives to expedite the clearance of accumulated goods, which if not addressed promptly, may be declared abandoned and subject to legal actions. The Customs Authority has expressed concerns over the extended storage of goods, leading to escalated fines and additional fees from storing companies and shipping agencies, thus increasing the financial burden on goods owners and importers. To mitigate these challenges, the authority is emphasizing the need for shipping agencies to assist in the efficient release of goods, which will contribute to faster clearance processes at ports. This move follows a recent directive issued by Ghatouri, which aligns with the Prime Minister's initiative to address the issue of abandoned goods at various customs points. Directive number 18 of 2024, repealing the earlier directive number 43 of 2024, stipulates that no customs administration shall refer goods to the general administration of abandoned goods or initiate sale procedures without a detailed memo from the concerned customs administration. This memo must outline the goods' conditions and any applicable expiration dates. Additionally, the directive mandates customs administrations to proceed with referring goods to abandoned status and their sale in accordance with the provisions of the Customs Law number 207 of 2020 and its implementing regulations starting from April 1. In a broader context, the Cabinet, led by Prime Minister Dr. Mostafa Madbouly, recently convened with major market stakeholders to discuss measures aimed at reducing prices and easing the economic burden on citizens. This meeting, part of a larger governmental effort to stabilize the market, included discussions on the availability of dollars and the clearance of goods worth over $4.5 billion at ports, highlighting the government's concerted efforts to address logistical and financial challenges impacting the maritime and trade sectors. The Egyptian government's proactive steps, as directed by the Prime Minister and supported by various ministries, underscore a committed strategy to enhance the efficiency of port operations and improve the economic landscape for importers and businesses relying on swift goods turnover at national ports. 🛃 Latest Customs News We have collected for you the main news of the last days concerning customs clearance. ✅ Draft amendments to the 18th Annex of PP RF 353 Until October 14, there will be a discussion of the draft amendments to the 18th Annex of the Decree of the Government of the Russian Federation of March 12, 2022 № 353. It is this Annex that establishes simplified declaration of imported goods. It is assumed that its procedure will be changed, namely, a list of specific products with the TN VED code and country of origin will be introduced, in respect of which the very simplified rules will apply. Now there is just a list of exceptions, there are no general rules under which products fall or do not fall. ✅ Simplification of customs control of containers in the EAEU The Eurasian Commission has made the following decisions. 1. When goods are transported by rail in containers, it is the container that must be the means of transportation for the purposes of customs control. For the purposes of customs control, it does not matter which platform is under the container. Accordingly, the issues of reloading from one platform to another, if, for example, in the course of transportation there is a technical failure, are significantly simplified. 2. For transit shipments through the territory of the Eurasian Union, it is not necessary to indicate the invoice value of goods being transported. In the future, this may have a significant impact on issues relating to the introduction of electronic document management. In practice, a legal regulation arises where it may not be necessary to attach an invoice to a transit declaration. ✅ The materials of customs inspections are to be allowed to be copied The persons being checked want to guarantee the right to familiarize themselves with and copy the materials of customs inspections. Such a draft law of the Cabinet of Ministers was recommended for adoption in the second reading at the meeting of the State Duma Committee on Budget and Taxes. The document obliges the customs authority to provide the audited person or his representative the opportunity to familiarize with the materials of the customs audit no later than five working days from the date of submission of the relevant application. According to the initiative, familiarization involves visual inspection of the document, making extracts from it and copying (photographing). Egyptian Customs Authority Standardizes Ship Bunkering Procedures Shipping Arabia, August 16, 2024 — The Egyptian Customs Authority has released a set of comprehensive guidelines under Procedures Circular No. 8 of 2024, aimed at standardizing and regulating ship bunkering operations across all Egyptian ports and airports. These guidelines are designed to align with international standards, such as the Kyoto Convention, and national regulations, including Customs Law No. 207 of 2020 and Import and Export Law No. 118 of 1975. The new protocols introduce unified customs procedures for provisioning ships, aircraft, and trains with necessary operational supplies like fuel and lubricants, excluding spare parts. This standardization ensures consistent treatment of goods consumed by passengers and crew or sold during voyages. Detailed provisions for bunkering operations specify the process for both Egyptian and foreign vessels using local and foreign goods. These operations are exempt from duties and taxes under conditions validated by customs, considering the number of passengers, crew, and voyage duration. Bunkering requests must now include comprehensive documentation, such as the vessel's name, docking details, shipping agency, and an inventory list. The Customs Authority is tasked with inspecting and verifying these details to ensure compliance before granting approval. The guidelines also cover the temporary release of equipment for repair and maintenance, requiring customs guarantees to cover potential duties. The return of repaired items is closely monitored, updating customs records to ensure accountability. Additional procedures address container repairs, ship maintenance, and waste disposal, necessitating authorization from the Port Authority and detailed submissions to Customs for any materials or waste management. Special procedures are also outlined for handling animal feed on ships carrying live animals and managing surplus supplies returned post-delivery. These measures include stringent checks to prevent unauthorized exports without proper duty payments. Through these guidelines, the Customs Authority reaffirms its commitment to enhancing operational efficiency and supervision, ensuring that all bunkering activities comply with the latest legal and regulatory standards. Authorized Economic Operator (AEO): Enhancing Global Trade Security and Efficiency The concept of Authorized Economic Operator (AEO) has emerged as a key element in striking this delicate balance. Developed within the framework of World Customs Organization (WCO) SAFE Framework of Standards to Secure and Facilitate Global Trade, AEO program comes with an objective of enhancing international supply chain security and trade facilitation. This article looks into the meaning behind the acronym AEO, its advantages as well as how it impacts on global business. Understanding the idea behind Authorized Economic Operator (AEO): An Authorized Economic Operator (AEO) is any party involved in the international movement of goods that has been approved by national customs administrations as being compliant with WCO or equivalent standards relating to supply chain security. These actors may comprise manufacturers, importers, exporters, brokers, carriers, consolidators, intermediaries, ports, airports, terminal operators, integrated operators, warehouses and distributors. When an operator attains AEO status it means that they meet certain criteria relating to matters concerning customs compliance; adequate records keeping; financial solvency; if required security and safety standards must also be met. The aim is to create an environment where trade can move more freely while ensuring the security of the supply chain. The Importance of AEO Status: Fewer Customs Inspections and Prioritizations: AEO-certified operators benefit from reduced physical checks and document verifications. In case inspections are required, they are given priority resulting in faster processing times. Streamlined Customs Procedures: AEOs have simplified customs processes, including less oversight and more straightforward administrative steps that help to reduce delays as well as operational costs. Improved Security: Through implementing strict security measures, AEO players contribute towards a secure global supply chain thereby mitigating risks associated with terrorism, smuggling and other undesired activities. Better Relations with Customs Authorities: Having attained the status of an authorized economic operator, more cooperation is enhanced with the customs administrations leading to a smoother interaction between them and fast resolution of any emerging issues. Market Recognition and Competitive Advantage: Being certified as an AEO enhances the credibility of a business giving it an upper hand over others in its sector. Mutual Recognition Agreements (MRAs): For instance, countries with AEO programs often enter into Mutual Recognition Agreements which allow for mutual recognition of one another’s AEO statuses. In addition such reciprocity also facilitates international trade while strengthening supply chain security globally.
