The Malaysia Competition Commission (MyCC) today announced its Decision against 7 companies for bid-rigging in Ministry of Defence tenders worth RM20.8 million in 2017 and 2020. The Proposed Decision was previously announced in December 2023. Based on MyCC’s announcement, sub-contracting was also involved, with a winning party immediately subcontracting the tender to another party in the bid rigging cartel, in exchange for 5% of the tender value. This latest announcement is another step in the Commission’s crackdown on bid-rigging. In April this year, the Commission announced a proposed decision against 8 other companies in relation to JKR tenders worth approximately RM473 million. Bid-rigging is prohibited under the Competition Act 2010, and forms part of the ‘hardcore’ horizontal agreements expressly set out under Section 4. #competitionact2010 #mycc #aktapersaingan
