Microsoft Corporation has agreed to pay $14 million to settle claims by the California Civil Rights Department that it unlawfully penalized employees who took medical or family-care leave. The allegations included retaliation against California-based workers using parental, disability, pregnancy, and family-care leave since 2017, affecting their career advancement opportunities. Although Microsoft denied wrongdoing, the settlement aims to resolve a multiyear investigation, providing relief to affected employees and implementing measures to prevent future discrimination. This includes hiring an independent consultant to review company policies and providing training to managers and HR personnel. #Microsoft #LeaveDiscrimination #CaliforniaCivilRights #EmployeeRights #SettlementNews #HRPolicies #CxONews #CxOGlobalForum

I’m honored to be quoted in this insightful piece by Pavithra Mohan in Fast Company, which explores the impact of tech industry layoffs on pregnant women and new moms—this isn't an aberration. The article sheds light on the challenges faced and calls for necessary protections for these vulnerable groups. A must-read for anyone interested in workplace equality and AI's role in layoff decisions, which, in my view, negatively impact new moms more insidiously than human decisions alone, although human decisions alone are bad enough for pregnant women, who need greater proactive protections. #WorkplaceEquality #PregnancyDiscrimination #AI

I want to extend my gratitude to Noelle Newbold for sharing her insights on the challenges women face in today’s workplace, especially with Amazon’s RTO policy. As someone who became a mother before the COVID era, I can deeply relate. I’m fortunate to have a husband who is an equal partner in parenting, but even then, I found myself having to hide the fact that I was a mother while working in highly competitive environments. The moment people knew I had a child, I started experiencing the subtle—and sometimes not so subtle—penalties of motherhood, regardless of age or gender. It's unfortunate that many still don’t understand what it's like to be a mother striving to build a career. It wasn’t until I joined a remote agency that I was able to be more present at home, but I had to put my leadership journey on hold. That pause came at a cost, and it wasn’t until I worked for a company with strong female leadership that embraced flexibility that I found balance again. This environment allowed me to grow as a leader while being more involved with my child’s life, and for the first time, I felt that both parts of my identity—professional and personal—were being supported. The pandemic changed everything for my family. My husband and I both worked hybrid schedules, and it gave us more time together with our child. This experience helped us build a stronger family connection, and I truly believe this kind of balance isn’t just good for families—it’s good for society as a whole. It allows women to lead and thrive in their careers while men gain a deeper understanding of the challenges their partners face. I know I’m privileged to have had this experience, but we must recognize that many women don’t have the same opportunities. If we continue to operate with outdated expectations, we risk holding back not just individual women, but entire generations of leaders. Flexibility in the workplace—through hybrid and remote work—empowers mothers to pursue their careers, strengthens families, and leads to a more equitable society for everyone.
"Rigid RTO mandates won’t just hurt working moms," writes BASIC/DEPT®'s Noelle Newbold. "Those who are disabled, caregivers, neurodivergent and immunocompromised are likely also affected by Amazon’s decision and its implications."

Want to take maternity or paternity leave from your job at Google? Think twice. Our client was laid off while on maternity leave, and she wasn’t the only one. Gomerman | Bourn & Associates has filed a discrimination lawsuit on her behalf against Google and their parent company Alphabet Inc. Attorney Maria Bourn says our client “was a dedicated employee who put off having children for Google and when she had a baby her worst fears came true, she was let go. Google’s conduct was not limited to [her], but several others on maternity or paternity leave were all let go at the same time.” Our client worked for Google for 15 years before she got pregnant. “Google forces their employees to choose between their jobs or starting a family,” the former employee says. “They turned what should have been one of the most joyous times in life into a nightmare.” In total, seven employees were terminated and five of them were either on maternity/paternity leave at the time or had recently returned from leave. This kind of discrimination is unacceptable and we are honored to represent this dedicated former employer in her action. If you have been unlawfully terminated or faced discrimination as an employee at Google or any other company, you have options. Microsoft has recently agreed to a $14.4 million settlement with the California Civil Rights Department to resolve allegations of retaliation and discrimination against employees who took protected leave, including parental and disability leave. The California Rights Department launched a multi-year investigation and alleged that employees who took leave for pregnancy, disability, or family care received lower bonuses and unfavorable performance reviews. These practices negatively impacted their eligibility for merit pay increases and promotions, disproportionately affecting women and people with disabilities. This settlement underscores the importance of equitable compensation and performance review practices, ensuring that taking legally protected leave does not harm employees' career progression. https://lnkd.in/daT9eSaE

Having built in the leave space for the past 4 years one thing I know without doubt is how important it is for companies to walk the walk when it comes to employee utilization of leave. It’s easy to have a leave policy and check the box, it’s much harder to create a culture where people feel comfortable *using* the policy without fear that it will put them behind. Many companies think about leave as a “pause” in the employee’s journey at the company. At Cocoon, it’s simply a part of your trajectory. Kerri Graham joined us a member of our CS team and came back from parental leave in March as leader of our CS org. Christina Walker Rakestraw previously led our CS org and came back from her parental leave in March as leader of our Sales org. If you’re building a culture where you recognize and reward high performance, an employee taking leave shouldn’t change anything in that equation. Leave doesn't negate the impact someone has had or can have on the company. Stories like this demonstrate how prevalent the “leave penalty” still is across companies big and small. Everyone is better off, employee and employer, when that leave penalty is eliminated. https://lnkd.in/gdgf-Y8D
