Last week was again an exciting week in terms of class actions: > Our Amsterdam office hosted the International Financial Services Litigation and Regulatory practice meeting where colleagues from around the world gathered to discuss (litigation) trends in the financial sector. Class actions were high on the agenda during this event. In addition to colleagues sharing their views, we received interesting contributions from our valued clients and (equally interesting) opposing perspectives from Milieudefensie (Friends of the Earth) and litigation funders. We could all agree that the number of class actions in the financial sector is likely to further increase over the next years. > On Friday I attended the first-ever seminar of the new Dutch class action association (Vereniging voor Massaschade en Collectieve Actie ). Collective settlements were at the centre of the debate during this seminar. We discussed whether the (already claimant-friendly) Dutch class action regime provides sufficient incentive to enter into a collective settlement. Time will tell! #Classactions #FinancialServices

In a recent Trends Kanaal Z interview, Crowell’s Charlotte Stynen and Evelien Van Espen discuss Belgium’s updated class action law, which now enables investors to bring claims for breach of prospectus legislation – a shift that could streamline cases like the Arco situation. While this reform brings new possibilities, challenges remain. These include the lack of potential financial windfalls from taking on class actions in Belgium as a group representative. On 7 and 8 March, the Belgian Presidency of the Council of European Union organised the 7th intersessional meeting of UNCITRAL: United Nations Commission on International Trade Law Working Group III on the reform of investor-state dispute settlement. On 7 March, I had the pleasure to chair the introductory panel on "Improving Access to Justice for All" together with WGIII Rapporteur Natalie Y. Morris-Sharma, UNCTAD's Vincent M. Beyer, professor Catharine Titi and ClientEarth's Amandine Van Den Berghe. Our panel discussed how efficiency, legal certainty and the preservation of host states' policy space can contribute to 'justice', and how the various measures proposed in WG III, ranging from a standing mechanism over an advisory centre on ISDS, counterclaims, non-disputing party interventions, amicus curiae interventions, to mediation, etc., can improve access to ISDS. My congratulations and gratitude to Belgium's Bernard Quintin, Christophe Payot, Laurence Bielen, Gauthier Masco, and to UNCITRAL WGIII's driving forces Shane Spelliscy, Natalie Y. 🗓️ Yesterday, an insightful conference took place where Rafal Kos participated as a panelist at the DIS goes Vis: The Innovation Breakfast discussion on “Presentation of the DIS-TPNR: The problem and its solution before state courts and in arbitration”. 🎯 The focus of the discussion was on the recently launched Supplementary Rules for Third-Party Notices (DIS-TPNR). 💡 DIS-TPNR aims to simplify the inclusion of third parties in arbitral proceedings, eliminating the need for complex contractual drafting. This innovation mirrors the benefits of third-party notices in state court proceedings and has the potential to enhance consistency and reduce procedural complexity in arbitral proceedings. The discussion was incredibly inspiring, thanks to the panelists who are industry experts: Florian Cahn (Framatome GmbH), Dr. Anna Kaehlbrandt (Hengeler Mueller), Reinmar Wolff (Deutsche Institution für Schiedsgerichtsbarkeit e.V. Interesting article An International Convention on Expert Determination And Dispute Boards ? This article makes a case for an international convention on expert determination (ED) and Dispute Boards (DBs) that would require its Contracting States to recognise agreements on ED/DBs and enforce ED/DB decisions. Whilst strong, the case for the convention may not be compelling as there are arguments against it. But at least the time has come for the international legal community to start thinking about and debating the need for such an international regime. This article takes the f irst step towards imagining this international regime by evaluating a number of key issues relating to its scope of application.
