Revisiting the AER’s Review of the Regulatory Framework Over the past three years, the AER has completed several reviews into it’s exempt guidelines – including most recently releasing it’s issues paper and review of the exempt framework. Across these reviews, there are a number of consistent themes, interpretations and signposts provided that allow Exempt providers to extract value, plan for potential change, minimise their risk, and place themselves in a position of strength when that change comes. EMD 🎉 Yesterday the European Parliament took a final vote on the reform of the EU Market Design (EMD). After Parliament’s approval, Council also needs to formally adopt the legislation to become law. So what does this concretely mean for 🇪🇺 Market Coupling? We are excited to share that the TVA 2025 Draft Integrated Resource Plan (IRP) and associated Draft Environmental Impact Statement (EIS) will be published on Monday, September 23, at tva.com/irp. This announcement will appear in the Federal Register on Friday, September 27, opening the public comment period which will extend through November 26. The IRP provides strategic direction on how TVA will continue to provide low-cost, reliable, resilient, and increasingly cleaner electricity to the 10 million residents of the Valley region. TVA has worked closely with a diverse group of stakeholders throughout the process and provided opportunities for public feedback during the EIS scoping period. Stakeholder engagement and public involvement continue to be critical components of the IRP process. To ensure transparency and awareness, we will host 10 in-person public open houses across the Valley to provide an update on the 2025 Draft IRP and Draft EIS findings. TVA will also host two public virtual webinars. Dates, venue locations and details will be available on September 23 at tva.com/irp.

On 9 April 2024, the California Air Resources Board (CARB) released the Standardized Regulatory Impact Assessment (SRIA) for the proposed amendments to California's cap-and-trade regulations. This impact assessment, filed with the California Department of Finance (DOF), is one of the steps the CARB must take before starting the formal rule-making process to amend the cap-and-trade regulations. This release has been highly anticipated by program participants, as it shows that CARB is taking steps to complete the process, which has not been updated since the public webinar in November 2023. The proposed amendments within the SRIA align with ClearBlue's previously stated expectations, especially with the likely adoption of a 48% emission reduction cap scenario. Participant response seemed enthusiastic, with the Front Month appreciating by 3.4% following the SRIA release. A full summary of proposed amendments and additional observations by our analysts is available to ClearBlue clients in Vantage, our carbon intelligence platform. We will continue to monitor and report on any regulatory updates.

On April 2, the participating RGGI states released the Compliance Summary Report for the fifth RGGI control period, which shows that 99.9% of emissions from covered power facilities were in compliance this period.
