Good morning from Las Vegas! CAI world is very busy this week! Of the more than 45,000 CAI members, it’s likely you’re involved in some way in this incredibly important work of creating communities that are preferred places to call home. If not, you can be! Policy Work: 41 states, the District of Columbia, and Congress are in regular legislative session for 2024 and we’re tracking and advocating on more than 2,300 bills. Leadership Work: The Board of Trustees and Member Representation Groups meet for their first group of business meetings and strategic discussions this week Tuesday and Wednesday. Legal Work: More than 700 community association lawyers, insurance professionals, and community managers will take over the Aria in Las Vegas to connect, share knowledge and expertise, discuss pressing issues facing community associations, and celebrate each other’s success while enjoying the opportunity to have a meaningful impact on the lives of millions of people living and working in community associations; here in the U.S. and across the globe!

This is the exact reason why I am dedicated to building a first party, bad faith, insurance practice as part of my law practice. Among the many issues that Americans face far too regularly: insurance companies deny claims with absolutely no basis to do so; the fact that vision and dental are somehow treated as separate from one’s health (this is an odd legal fantasy we should not put up with); and finally the fact that both federal and state mental health parity laws are never practically enforced. These and other practices are a result of the lack of regulation and accountability insurance companies are held to. In other words, they have no incentive to do what we pay them to do, since no one is forcing them to do it.
It isn’t just that we are on the verge of ceasing to be a democracy. The fundamental problem in the American culture is that integrity and honesty are no longer considered priorities, and our politics and the illness profit system are perhaps the greatest examples of what we have become.

Did you know that in Colorado, in medical negligence cases, NO MATTER THE INJURY, you can ONLY ever receive a maximum of $300,000 for the combined damage categories of non-economic damages and physical impairment? This not only makes it impossible for individuals to recover fair compensation for their injuries, but it also makes it nearly impossible for these individuals to even find attorneys to represent them. Colorado is one of 26 states that had legislators pass laws that placed CAPS on damages for medical negligence. This November, there is a ballot measure to correct this injustice. Justice Beyond Punishment: The path to redemption for individuals involved in white-collar incidents often involves unique challenges. Unlike some actions, consequences extend beyond imprisonment. These individuals, often highly educated professionals such as doctors, lawyers, and accountants, etc., confront the harsh reality of losing their professional licenses, which are the very bedrock of their careers. The burden of restitution can be immense, further impeding their ability to rebuild. Perhaps most concerning is the lack of resources tailored for this demographic. Rehabilitation programs frequently target different groups, leaving these individuals with limited options to address the root causes of their actions and acquire the essential skills to reintegrate into a professional environment. This amalgamation of factors creates a scenario where skilled individuals are trapped in a cycle of hopelessness, impeding their financial recovery and representing a substantial loss of valuable expertise for society. Moving Forward: Risk-Based License Reinstatement: Instead of imposing blanket bans, consider a risk-based strategy. Assess the severity of the offense, the harm inflicted, and the individual's demonstrated remorse and efforts at rehabilitation. Permit conditional license reinstatement following a period of good behavior and completion of mandated programs. Focus on Rehabilitation: Establish initiatives that target the underlying causes of white-collar crime, providing individuals with the tools to avoid future transgressions. This might involve ethics education, financial literacy training, and mentorship programs. Societal Shift: We require a societal shift that recognizes the potential for redemption. Direct less attention to permanent stigma and more towards fostering a supportive atmosphere where individuals can reconstruct their lives and make positive contributions. Benefits for All: By adopting a more nuanced approach, we can achieve a mutually beneficial outcome. Public safety is safeguarded by ensuring individuals are genuinely remorseful and equipped to prevent future misdeeds. Society gains by reclaiming valuable skills and expertise that bolster the economy. Most importantly, individuals are afforded a genuine opportunity to rebuild their lives and reemerge as productive members of society. This is Second Chance Month, let's advocate for a justice system that offers authentic avenues for rehabilitation and reintegration, for those involved in white-collar incidents and beyond. #FairChances #Secondchancemonth #secondchances
