A few weeks ago, our colleagues Katharina Anuscheh Behrend, LL.M. and Leonel Lisboa participated in a workshop co-hosted with the Responsible Contracting Project and the German Institute for Human Rights to discuss the 𝗭𝗲𝗿𝗼 𝗗𝗿𝗮𝗳𝘁 𝗼𝗳 𝘁𝗵𝗲 𝗘𝘂𝗿𝗼𝗽𝗲𝗮𝗻 𝗠𝗼𝗱𝗲𝗹 𝗖𝗹𝗮𝘂𝘀𝗲𝘀 (𝗘𝗠𝗖𝘀). These clauses are designed to embed human rights and environmental due diligence (#HREDD) into supplier contracts, aligning with the EU Corporate Sustainability Due Diligence Directive (#CSDDD). Led by the Responsible Contracting Project and supported by the Initiative for Global Solidarity, this ongoing consultation process seeks input from diverse stakeholders to shape the final EMCs. We are seeking your feedback! 📣 The second round of consultations is now open for the Zero Draft of the European Model Clauses (#EMCs). The EMCs are a set of model contract clauses tailored to the new EU Corporate Sustainability Due Diligence Directive (#CSDDD) and other voluntary and mandatory human rights and environmental due diligence (#HREDD) requirements, like the #UNGP or #LkSG. Important event organised by the Global Association of Impact Lawyers (GAIL) on the EU Corporate Sustainability Due Diligence Directive (CSDDD) and what legal tools you need to implement it. As a reminder, the just adopted CSDDD applies to large companies (including certain non-EU companies) and will gradually apply to companies in scope, and will soon start to start important traction. It is a real game-changer for businesses, whether they are directly or indirectly in scope (e.g. because they are a supplier to an in-scope business). Amongst other responsibilities, it includes a new due diligence duty to be integrated into corporate policies. This requires companies to identify, prevent, mitigate, minimise and end adverse human rights and environmental impacts in their own operations and in their subsidiaries, and also extending to their supply chains and certain business practices. The CSDDD is not only an important opportunity to (re-) focus on ethical business, it also has wide-ranging consequences if companies get it wrong as e.g. victims of breaches will be able to bring a civil liability claim for damages before the national courts. In December 2023, EU lawmakers reached a tentative agreement on the Corporate Sustainability Due Diligence Directive (CS3D), a significant piece of EU legislation designed to compel companies to mitigate their adverse impacts on human rights and the environment, both within the EU and globally. While CS3D is pending formal approval by the Legal Affairs Committee and the European Parliament, all involved parties have demonstrated their dedication to advancing this legislation. 🚀🌟 CSDDD directive diluted but saved 🌟🚀 Last Friday, the Corporate Sustainibility Due Diligence Directive was approved by the EU member states. The Directive, still subject to the European Parliament approval, will be a diluted compromise which was only possible after a frustrating process that has severely undermined the credibility of the EU’s legislative process. The final text will therefore be diluted, because many concessions had to made along the way. However, the win is still there. After weeks of intense negotiations by the Belgian Presidency of the Council of the European Union 2024 and ups and downs in the EU political process, the CSDDD is there. And though our action with the Belgian business statement might have been symbolic, it certainly didn't go unnoticed (https://lnkd.in/e9k_WDtU) And we will continue to do just that, gather support for due diligence with progressive businesses because we believe in its importance for sustainable value chains.
