📣 The Netherlands Arbitration Institute (NAI) just released its new arbitration rules, applying to arbitrations filed as from 1 March 2024. The NAI arbitration rules had been last revised in 2015. The newly released rules present, 9 years later, many new features, including: 👩⚖️ a midstream conference after the first round of submissions to consult on the further course of the arbitration 🖋️ a scrutiny of the draft award by the NAI ⏰ expedited arbitration proceedings 📩 the NAI arbitration platform for secure communications 🌱 the obligation to account for the importance of sustainability issues as well as diversity and inclusivity. In a recent case before the #Luxembourg Court of Appeal, where DLA Piper in Luxembourg represents the appellant, the Court confirmed the admissibility of our appeal. The decision focused on two key procedural issues: ◾The "double date" principle with respect to service of procedural documents, within the European Union, in accordance with the Regulation (EU) 2020/1784 of 25 November 2020 on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters; ◾When an interlocutory judgment can be appealed.   This decision is particularly interesting as it reiterates established case law and clarifies its application, providing greater legal certainty for the application of appeal deadlines in complex and cross-border disputes.   For more details, read the article: https://lnkd.in/gvafgYKc. Chiann Bao, Queenie Lau and Natalie So provide a revised and updated version of their Practical Insights topic on the law applicable to arbitration agreements.   Determining the law applicable to arbitration agreements involves crucial considerations. It is essential to choose the law governing the agreement, which addresses issues of existence, validity, legality and interpretation.   Different jurisdictions use different approaches, including implied choice, closest connection, law of the seat, law of the underlying contract, pro-validation principles and recourse to international/transnational law. Inconsistencies can arise at different stages of the process, highlighting the need for parties to explicitly state the applicable law to avoid uncertainty.   The choice of law may establish preconditions and rules of interpretation that affect the validity of the agreement.
