Webinar: "Law is not planning" Speakers: Dr Stephen Riley, Leicester Law School, University of Leicester Date and location: June 11th, 14:00-15:00, Zoom webinar and Lecture Theatre 5, Bennett Building, University of Leicester Registration form: https://lnkd.in/eekQHbzG Seminar summary: Using the examples of Sharma and KlimaSeniorinnen we can identify three ways in which law limits or undermines our planning for the future. First, in opposition to politics, law must respect the separation of powers and must accept presentism where this follows from precedent. Second, in opposition to critical morality, law imposes conservative limits on what could count as permissible sacrifices for the future. Third, in opposition to nature itself, law privileges anthropocentric human values and ends. Using this analysis, we can give a comprehensive account of why high-profile climate cases in the courts can never be a substitute for more fundamental moral, political and ideological change. More theoretically, given the inescapability of these oppositions in our understanding of law, this analysis indicates why any theory of ‘law as planning’ is wrong. Speaker Bio: Dr Steve Riley is Associate Professor in the Law School of the University of Leicester. Riley’s research connects the philosophy of law and future generations. Specifically, how legality can form part of intergenerational justice especially how law can contribute to limiting the 'demandingness' of intergenerational justice; conversely, how problem futures provoke question about law's own survival. He has also written extensively on the topic of human dignity and law, producing a monograph and several articles in leading journals. His specific concern is with the ‘foundational’ claims associated with human dignity. On 3 and 4 April 2025, Erasmus School of Law and University of Groningen, Faculty of Law co-organize the conference 'Law in the Age of Transitions' in Groningen, as part of the Sectorplan Rethinking Public Interests in Private Relationships. Societal challenges and transitions related to climate change, public health and economic prosperity converge with political-economic and governance transitions. Legislative initiatives like the Digital Markets Act, the Digital Service Act, the Net-Zero Industry Act, or the Critical Raw Materials Act have far-reaching ambitions and shake-up the political economy of the Union. In a new empirical study published in the Nordic Journal of International Law, Silvia Steininger of the Centre for Fundamental Rights - Hertie School, along with co-authors William Hamilton Byrne & Raphael Oidtmann, maps how international law interacts with the social sciences via a detailed analysis of scholarship & funding structures. This is a research project which encompasses over 15,000 documents from 1907 until 2022, delivering insights into both temporal and regional trends within the relationship between international law and the social sciences. 👇 Read the paper here: https://lnkd.in/divETfqM

Happy to see the special section on truth in law (no less!) out in this new issue of the European Journal of Legal Studies - based on a workshop co-created with Helga Molbæk-Steensig at the European University Institute in 2022. My contribution "Overcoming Temptation?" draws on work co-authored with Mikael Rask Madsen on the on the alleged empirical turn in (international) law. Using our taxonomy to assess the contributions, I tentatively submit that IL-scholarship may be experiencing some measure of empirical fatigue.
