The definition of AI. The kind post below about our recent Hardian Health Tech Summit contained a question about what people think of the definition of AI from the #EUAIact. Good question. The definition of AI from Art. 1(1) of the EU AI Act that became EU law on 1st August 2024: ‘AI system’ means a machine-based system that is designed to operate with varying levels of autonomy and that may exhibit adaptiveness after deployment, and that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments; A different definition, this time from §940(3) of the USA's National Artificial Intelligence Initiative Act (NAIIA) 2020 that became US law on 1st January 2021: The term “artificial intelligence” means a machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations or decisions influencing real or virtual environments. Artificial intelligence systems use machine and human-based inputs to— (A) perceive real and virtual environments; (B) abstract such perceptions into models through analysis in an automated manner; and (C) use model inference to formulate options for information or action. The OECD has a definition also, adopted by them on 22nd May 2019: An AI system is a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. Different AI systems vary in their levels of autonomy and adaptiveness after deployment. I'm sure there are more e.g. the UK ICO's (Information Commissioner's Office). The key themes, for me, are inference and perception. It might be tempting to overuse or misuse the notions of inference or perception for marketing, but the EU AI Act's Recital no. 12 has for me the key points for valid use of the term AI "... the definition should be based on key characteristics of AI systems that distinguish it from simpler traditional software systems or programming approaches and should not cover systems that are based on the rules defined solely by natural persons to automatically execute operations. A key characteristic of AI systems is their capability to infer..." Comments, please...

This included 💵where the money comes from, 🔬updates on evidence generation for AI and software, 🪄 challenges of regulating generative AI, 🤖 acceleration of medical device development through the IDAP process, ✅️ key aspects of the EU AI act, and 🪟 procurement frameworks for AIaMD. The U.S. FDA announces technical experts and industry representatives for its Digital Health Advisory Committee (DHAC) ⚖️The committee consists of 9 voting members with medical/academic experience plus digital health expertise, alongside 18 private sector leaders from Pharma, Medtech, and Venture representing industry interests. ⚖️ The panel will advise the FDA on digital health technologies, including AI/ML, virtual reality, wearables, digital therapeutics, and remote patient monitoring, with its first meeting in November focused on generative AI in medical devices. ⚖️ DHAC will also address issues like decentralized clinical trials, patient-generated health data, real-world data, real-world evidence, and cybersecurity. ⚖️ The committee will identify risks, barriers, and unintended consequences of FDA policies on digital health tech and advise the FDA on its use in clinical trials and postmarket studies. 💬It’s like the World Series of Digital Health - with only US based players allowed! Digital health is an interconnected and borderless field yet all 9 voting members are U.S. based same for 17/18 of the extended team (the exception is in Ireland but was previously U.S. based) 💬 A prime focus on the U.S. makes sense but this skewed composition is a missed opportunity and will likely limit the boards ability to exchange and assimilate global best practices and approaches.
