⚖ 💰 Do you know you may get a financial reward up to 25% when you report violations of #Saudi_labor_law? It is stated clearly in Article 233 of #KSA_labor_Law as follow: “Article 233 The Minister may grant a financial reward of not more than 25% of the amount of the fine collected to inspectors and others who help in uncovering any of the violations of the provisions of this Law, its Regulations, and the decisions issued in implementation thereof.” Note: please use the ongoing labor law that I attached in the previous posts. I will add the link the comments. I do not know if anyone talked about this, and there is a free online service for that. I think full transparency is a must to spread legal awareness all workers (Local and international), especially more for international workers in Saudi Arabia. I will address it quickly for now. I might revisit it again in the future. One way to report the violations is through the mobile application. There are other ways as well such as a phone call or a visit to their violation labor office in your city. "This e-service allows the users to report any violations of labor regulation in the private sector. Their reports will be sent to the responsible team in the Ministry of Human Resources and Social Development without the need to visit the entity. As a result, this will create cooperation frameworks and connection to activate the monitoring and reporting process between the citizen and the Ministry towards workplace without violations." It is highly unreasonable to enact order after order and scrutinizing local businesses for their taxes yet when business owners appeal for something so simple as an error in CSOA, it takes your officers ages to get issues resolved in a timely manner to ensure that business activity in the economy is not only left to larger companies and foreign owned enterprises. Here’s some tips to consider; - Review ALL HR Practices and Policies - Enact strict Performance Based Standards - “Hire & Fire” for menial designations - Visit and Perform CBAs in ALL NATIONWIDE BRANCHES - ETC! because there’s so much!

‘’Non-Compete Clauses in Nigeria: What You Need to Know" First and foremost, what is a non-compete clause? Simply put, it's a contractual agreement between an employer and an employee, or between businesses, wherein the party agrees not to engage in certain competitive activities for a specified period and within a defined geographical area after the termination of employment or business relationship. For employers, non-compete clauses are vital for protecting confidential information, trade secrets, and proprietary knowledge. By preventing former employees or business partners from engaging in activities that directly compete with their interests, employers can mitigate the risk of unfair competition and safeguard their investments. On the flip side, employees and entrepreneurs may view non-compete clauses as restrictive barriers that limit their career prospects and entrepreneurial freedom. After all, being bound by such clauses could potentially hinder their ability to seek new opportunities, launch their ventures, or leverage their skills and expertise in the marketplace. So, where does Nigerian law stand on non-compete clauses? While there is no specific legislation governing non-compete clauses in Nigeria, they are generally enforceable to the extent that they are reasonable and necessary to protect legitimate business interests. Factors such as the duration of the restriction, the geographical scope, and the nature of the business activities covered are taken into account when assessing the reasonableness of these clauses. Non-compete clauses are now banned in employment contracts in the United States however, the ban does not apply to senior executives with access to trade secrets. That being said, non-compete clauses must strike a balance between protecting the interests of employers and respecting the rights and livelihoods of employees and entrepreneurs. Overly broad or draconian clauses that unduly restrict an individual's ability to earn a living or pursue their chosen profession may be deemed unenforceable by Nigerian courts. In conclusion, non-compete clauses play a pivotal role in the Nigerian business landscape, shaping the dynamics of employer-employee relationships and business transactions. While they serve as valuable tools for protecting legitimate business interests, they must be carefully drafted and judiciously enforced to ensure fairness and equity for all parties involved. The Public Benefits Organization Act, 2013 (PBO Act), now effective as of 14 May 2024, replaces the Non-Governmental Organizations Coordination Act, 1990. The new framework mandates that organizations seeking to enjoy benefits accruing under the PBO Act must be registered as a PBO. If an organization is already registered under another law in Kenya but wishes to register under the PBO Act, it must first deregister from that law.
