CONFERENCE ON THE CULTURAL CORPORATION Today at 2:30 PM I will give a presentation at the University of Verona about the impact of the rules of the Italian Code of Cultural Goods on the activity of corporations operating in the cultural fields in Italy (but not only). In fact, most of these rules tend to be completely overlooked by corporations, but are more and more strictly enforced by the Ministry of Culture, that recently has been even trying to pretend that they apply abroad too (the Ravensburger case being a good example, where the German court judging on the same matter said straightforwardly that the application of Italian law abroad was simply countrary to international principles of law). On May 29, the President of Paraguay signed Law 7274 of 2024, published the same day. This law accepts the Host Country Agreement with the Permanent Court of Arbitration (PCA), which, in essence, ensures that Paraguay provides an environment conducive to the functioning of the PCA and its proceedings within its jurisdiction. Through this agreement, Paraguay commits to ensuring that adjudicators, PCA staff, and proceedings participants, such as counsel, agents, and witnesses, can perform their functions under similar conditions to those guaranteed under the PCA’s Headquarters Agreement with the Kingdom of the Netherlands. The agreement also regulates the privileges and immunities the host country provides to adjudicators and participants in PCA-administered proceedings, among other things. However, Judge Contreras made it clear that the American Congress, in implementing the treaty to enforce such awards, had effectively barred Spain’s path. The judge’s message was clear: Congress had shut the door on these arguments long ago, and no amount of EU legal alchemy could reverse that decision." When is a non-exclusive jurisdiction clause actually an exclusive one? In Dexia v Patrimonio del Trentino, the Italian parties agreed to the exclusive jurisdiction of the English courts but also agreed that would not preclude them from bringing proceedings in the Italian courts... The Commercial Court decided this was still an exclusive jurisdiction clause in favour of England. The judgment contains a forensic analysis of the clause - and its context within an ISDA Master Agreement. It also covers: ☑ The scope of the 'contract' gateway for service out ☑ The effect of Brexit on forum non conveniens arguments ☑ Whether an English judgment will be enforced in Italy under the 1964 Bilateral Convention between Italy and the UK ☑ And finally, (as is traditional in the Italian swaps litigation), commentary on the expert evidence. The court dismissed both parties' applications to rely on expert evidence on Italian law and also criticised the failure to provide a realistic time estimate to consider it. https://lnkd.in/dUgaetE6

Yesterday the Permanent Bureau of the HCCH had the honour of welcoming a delegation from Japan. The delegation was headed by Mr Ryuji Kawahara, Vice-Minister of Justice. He was accompanied by Ms Saori Kameyama, Assistant to the Director, Secretarial Division, Minister’s Secretariat; Ms Mayumi Komoto, Attorney, International Affairs Division, Minister’s Secretariat; Mr Katsutoshi Takahashi, Section Chief, Liaison & Coordination, International Affairs Division, Minister’s Secretariat; Ms Maki Masaki, Interpreter; and Ms Mio Takanashi, First Secretary, Embassy of Japan. The delegation met with Dr Christophe Bernasconi, Secretary General of the HCCH, accompanied by Ms Melissa Ford, Secretary and Head of the Transnational Litigation and Apostille Division, and Dr Louwrens Kiestra, Legal Attaché to the Secretary General.    The meeting provided an opportunity to discuss recent developments and to strengthen the long-standing ties between Japan and the HCCH. The delegation expressed Japan’s support for the ongoing work of the HCCH, including its preparations for the upcoming meetings of the Special Commission on the 1965 Service, 1970 Evidence, and 1980 Access to Justice Conventions, to be held in July 2024, and of the Working Group on Jurisdiction, to be hosted by Japan in October 2024.
