I am both encouraged and disheartened to see that the conclusions I reached in my dissertation, "The Impact of Cannabis use liberalisation on the workplace," submitted in July 2021, are becoming a reality. The recent article highlights several issues that I had anticipated and discussed in detail. The invaluable lessons learnt from other jurisdictions, which could have significantly mitigated the impact, were unfortunately ignored. We must act swiftly to address these challenges and ensure a balanced approach to cannabis use liberalisation that safeguards workplace productivity and safety. It’s crucial for policymakers and organisations to revisit and consider how other states mitigated the impact. Here is a post I modified slightly from two actual lawyers (and wonderful people) Anne Yuengert and Anne Knox Averitt about the pretty messed up situation where a job applicant was denied employment for failing a drug test on the basis of THC when the state law expressly prohibited employers from denying employment for failing a drug test on the basis of THC. Spoiler alert: Third Circuit sides with employer because the state statute did not contain a private right of action for the would-be employee to sue. To be clear, this holding does not necessarily open the door for reading similar provisions out of all state laws but it does (1) show yet another way the unwary cannabis user can find themselves on the wrong side of an issue involving cannabis and (2) provide a road map for how states should draft cannabis statutes. https://lnkd.in/eBbe94H5
