The Ministry of Communications and Informatics (MOCI) is on track to build Indonesia's Personal Data Protection Agency (PDP Agency), expected to launch in the second quarter of 2024. This agency will have significant authority to enforce personal data protection measures, including formulating policies, supervising implementation, and imposing sanctions for non-compliance under the PDP Law. Stakeholders, particularly data controllers and processors, are urged to align practices with the PDP Law by October 17, 2024 as compliance deadlines approach. Warning for Malaysia, we can't expect similar Indonesia dilemma in Malaysia. To attract foreign data centers, the Malaysian government must enforce strict mandatory #dataprivacy laws, requiring compliance from all sectors or face legal consequences. To the Honorable Minister of Digital Gobind Singh Deo When the government and private sectors are not compulsory required to comply with data privacy laws, several adverse effects and consequences can arise. 1.Increased Risk of Data Breaches: Without mandatory compliance, organizations might not invest adequately in data protection measures, leading to a higher likelihood of data breaches. This can result in unauthorized access to sensitive information. 2.Loss of Consumer Trust: Consumers are more likely to trust organizations that protect their personal data. Non-compliance can erode trust, leading to a loss of customers and damage to an organization's reputation. 3.Legal and Financial Consequences: Even in the absence of compulsory compliance, organizations can still face lawsuits and legal actions from affected individuals. The financial impact of such legal actions can be significant. 4.International Trade Issues: Many countries have stringent data privacy regulations. Non-compliance can result in restrictions or bans on data transfer from compliant countries, negatively impacting international business operations. 5.Competitive Disadvantage: Companies in regions with strict data privacy laws may have a competitive edge over those in regions without such regulations. They can market themselves as more trustworthy and secure, attracting more customers. 6.Increased Surveillance and Misuse of Data: Without legal constraints, there may be an increase in surveillance and misuse of data by both government and private entities, leading to violations of individual privacy rights. 7.Lack of Accountability: Without laws mandating compliance, there is less accountability for data misuse or mishandling. This can lead to unethical practices and exploitation of personal data. 8.Erosion of Privacy Rights: Over time, the lack of strong data privacy laws can erode individuals' privacy rights, leading to a society where personal data is routinely exploited without consent.
