100% agree with Daralyn that a lot of this is on the clients. Recently at a conference, “someone” (Chatham House rules) offered a provocative question as to why any in-house counsel would ever hire a female IP litigator given these lists. My thought was, well, in the last 12 months, I had a 100% female team achieve a full defense trial victory for me, and a 100% male team get dinged by a 9-digit damages verdict. So there’s that. And let me offer a slight suggestion that more can and must be done across the pipeline. Yes, clients must hire better. And firms must promote, support, and encourage better. And courts can play a part in a more intentional way. And we should all please stop supporting the proliferation of all these stupid vanity lists (clients don’t care. See above). And while we’re at it, we should kill the billable hour and all the evil metrics tied to it (woe to you, realization rate!).
MoFo’s Daralyn Durie, recently honored by the Daily Journal as a top woman lawyer, published an article in the Daily Journal’s Top Women Lawyers issue that underscored the gender inequalities in law and recounted uphill battles she and other women lawyers have had to climb as attorneys in a male-dominated industry. https://gag.gl/8K2geM

Respect and Equality As mentioned in my previous post the contributions by our Forum presenters were thought provoking and inspiring. Congratulations to the Forum co-hosts, Women's Legal Service and Capire Consulting Group. Joanna Abraham, President Women Lawyers Victoria addressed the important issue of how to make legal workplaces safer. Acknowledging that “we have a gender problem” and recalling a recent law function in which informal conversations revealed that senior men in law do not acknowledge that there is an ongoing problem - now that women are the majority of the profession. She suggested that we must “raise women up” and that we need policies and procedures that work. #Respect and Equality #Gendered Violence in the legal industry #leadership lens #Intersectionality issues

#Interview | #CDHWomenEmpowerment | Brigitta Mangale, Director in the Pro Bono & Human Rights practice, and Claudia Anne Grobler, Associate in the Dispute Resolution practice, were recently featured in the Sunday Times Celebrating Women issue, where they discussed 'Realising Women's Rights for an Equal Future.' Achieving gender equality is a complex process that requires the interplay of law, economic realities, and social dynamics. These elements must work together to advance the cause of equality, with the law playing a crucial role in securing women’s rights under our Constitutional framework. Our legal system continues to evolve in pursuit of these ideals. Brigitta highlights that in the quest for equality, lawyers and lawmakers are responsible for scrutinising and addressing missteps in our judicial processes. “Fortunately, review and appeal processes allow for a critical examination of the law and facts considered by lower courts,” she says. The Pro Bono & Human Rights practice is committed to contributing to generational equality through these efforts and is currently challenging the constitutionality of section 12(4) of the Prescription Act of 1969. “A successful outcome in this case would be a positive step forward for laws around sexual abuse, which disproportionately affects women.” Claudia notes that achieving equality is a journey influenced by societal views on women and girls, rape culture, and social dynamics—a journey we must all undertake together.
