A thoughtful article by my colleagues at Ropes & Gray--- attorneys Devin Cohen, Harvey Cotton, Emma Coreno, La’Dericka Hall, Jonathan Reinstein, Christine Rosenblatt, and Timothy Rozier-Byrd have provided a high-level summary of the changes between the proposed rule and the recently issued final rule implementing the nonquantitative treatment limitation (“NQTL”) comparative analyses requirements under the Mental Health Parity and Addiction Equity Act of 2008 (“MHPAEA”). The #Regulations seek to reinforce the obligations of group health plans and #HealthInsurance issuers under MHPAEA, by among other things, 1) placing a heightened focus on the elimination of more restrictive barriers to access to #MentalHealth and substance use disorder benefits as compared to medical/surgical benefits, 2) standardizing the definitions associated with the parity analysis for NQTLs applicable to mental health and substance use disorder benefits and medical/surgical benefits, and 3) clarifying the content and data evaluation requirements of the NQTL comparative analyses. The Department of Health and Human Services, the Department of Labor, and the Department of the Treasury (together, the “Departments”) have released the eagerly awaited final regulation under the Mental Health Parity and Addiction Equity Act (the “MHPAEA”). WA State, Health Care Authority's ConsentLink launches August 13, 2024. In 2020, the Health Care Authority initiated a project to enhance the sharing of substance use disorder patient information. On August 13 we announce the launch of ConsentLink, a fully compliant 42 C.F.R. Part 2, electronic consent management (ECM) tool, powered by Midato Health. We are thrilled to mark this milestone alongside our partner providers, Comprehensive Life Resources, Consistent Care, and Answers Counseling. The ECM is just one of Washington State Health Care Authority's phenomenal efforts to support providers and community-based organizations offering services to Washingtonians with mental health and substance use disorder conditions.
