This conference will address today's most challenging issues in competition law, economics and policy, including the main legal issues facing European and national courts, merger control and the economic approach in competition law. It will feature a unique panel of renowned national and international speakers from the Court of Justice of the European Union, the Competition, Regulation and Supervision Court of Portugal, the European Commission, the OECD, the Competition Authority, national and international academia, economic consultancies and law firms. Some months ago, Jose Rivas and I had the great opportunity to interview Cani Fernandez, Chairwoman of the Spanish Competition Authority CNMC (Comisión Nacional de los Mercados y la Competencia), for the March issue of World Competition journal. (EPPUR SI - CAFF, LDA.), in collaboration with the National Council of Law Students - Conselho Nacional de Estudantes de Direito (CNED), is heading to Luxembourg to visit the Court of Justice of the European Union (CJEU) to understand, raise awareness, and ensure that compatibility with EU law and the primacy of European Union law are fully recognized and respected in Portugal. We will be at the Court of Justice of the European Union from June 3rd to 5th. Our mission with this action is to ensure that the rights and obligations arising from Union law are fully respected in Portugal. We aim to promote greater awareness and defense of European citizens' rights, ensuring the correct application of EU law in our country. According to Article 267 of the Treaty on the Functioning of the European Union (TFEU), the CJEU has the authority to make preliminary rulings on the interpretation of the Treaties and on the validity of acts adopted by the Union's institutions. This competence is essential to ensure that national legislation is in conformity with community standards. Furthermore, Article 8, number 4 of the Constitution of the Portuguese Republic (CRP) establishes that the provisions of the treaties governing the European Union and the rules issued by its institutions, in the exercise of their respective competencies, are applicable in the domestic order. This principle of the primacy of EU law is fundamental to ensuring that Union law prevails over national rules in case of conflict. Today marks the 20 years of the European Competition Network (ECN) - a remarkable journey of cooperation to enforce EU Competition law ❗ 🤝 The ECN was established to ensure consistent and effective enforcement of EU competition law across the Member States. This network has been a pivotal platform for communication among the Commission and national competition authorities (NCAs). ℹ Over the years, the ECN has created a robust framework for sharing insights, experiences, and best practices. This collaborative approach has been crucial in addressing the evolving challenges of the modern economy, from the rise of digital markets 👩💻 to supply chain disruptions caused by the pandemic 👩⚕️ and global events like the war in Ukraine. Beyond fostering a common competition culture across Europe, the ECN has maintained a proactive stance ⬇ 📌 Between May 2004 and December 2023, NCAs have adopted more than 1,700 decisions based on Article 101 and/or Article 102 📌 The NCAs within the ECN launched, on average 140 investigations and adopted 75 decisions each year. 📌 Additionally, the Commission averaged 23 investigations and 11 decisions per year. Reflecting on two decades of success, it's clear that the ECN is a true success story. This week, our colleagues Claire Simpson and Erlend Leonhardsen, assisted by Gudlaug Jonasdottir and Rachel Harriott, represented ESA before the EFTA Court in Case E-14/24 Elmatica AS v Confidee AS and Vidar Olsen. 💡 Elmatica claims damages before the Norwegian courts for a breach of the national act implementing the Trade Secrets Directive (EU) 2016/943. In the course of this claim, a dispute has arisen about access to evidence containing trade secrets. It has been a pleasure and an honour to interview Cani Fernandez, Chairwoman of the Spanish Competition Authority (CNMC), and cover topics such as the success of the annual conference of the ICN in Barcelona in October 2023, the forthcoming trend areas in the field of competition law and policy, the cooperation between competition authorities and national courts including in the field of damages, sanctions to infringers beyond pecuniary sanctions to companies, the EU DMA and DSA, and the CNMC's cutting-edge AI tools to detect collusion in public procurement.

Pleasure to record a conversation with one of the leading voices in the area of EU competition law & policy – the Prosecutor General of the Belgian Competition Authority, a Visiting Professor at the College of Europe, an author of many impactful publications and books – Damien Gerard. We have started by examining the main specificities of the institutional settings of the Belgian Competition Authority, looking at other EU NCAs with similar and different architecture & examining pros and cons of different models. We then moved to the analysis of possible formats of co-existence of NCAs & governments. We then looked at the enforcement priorities of and some latest investigations by the Belgian Competition Authority.
