  • Exploitation of Vulnerabilities: Systems that exploit vulnerabilities of specific groups due to age, disability, or economic status to materially distort behavior causing harm.
  • Social Scoring by Governments: AI systems used by public authorities for general-purpose social scoring leading to detrimental or unfavorable treatment.
  • Real-Time Remote Biometric Identification: The use of real-time remote biometric identification systems, like facial recognition, in publicly accessible spaces for law enforcement purposes, with certain exceptions.

These practices are banned due to their potential to lead to discrimination, exclusion, or significant harm to individuals and society.

High-Risk AI Systems: Governance and Accountability

High-risk AI systems are subject to stringent requirements under the Act. These systems typically operate in critical sectors where their malfunctioning or misuse could have significant consequences. Providers of high-risk AI systems must:

  • Establish Robust Risk Management Systems: Identify, assess, and mitigate risks throughout the AI system’s lifecycle.
  • Ensure High-Quality Data Sets: Use training, validation, and testing data sets that are relevant, representative, free of errors, and complete.
  • Maintain Documentation and Transparency: Provide detailed technical documentation and clear instructions for use to facilitate compliance checks and user understanding.
  • Implement Human Oversight: Design systems in a way that allows human operators to understand and intervene in the AI system’s functioning when necessary.
  • Ensure Robustness, Accuracy, and Security: Develop AI systems that are resilient and secure, minimizing errors and risks.

Are there any sanctions is a company does business with another company not complying with the Act? I assume that companies would ensure their own house is in order as a priority. I would expect compliance to become part of vendor selection and RFT/RFQ/ITT processes. And potentially Know Your Customer processes. Have you seen anything about requirements up (or down) the supply chain Driss?
